EPA to Demolish Contaminated Building at Toxic Superfund Site in Garfield, N.J.

(New York, N.Y. – August 8, 2012) U.S. Environmental Protection Agency Regional Administrator Judith A. Enck was joined today by New Jersey Senator Frank R. Lautenberg, Senator Robert Menendez and Congressmember Bill Pascrell, Jr. as she announced that the EPA will safely demolish the E.C. Electroplating building at the Garfield Superfund site in Garfield, New Jersey. The building, located at 125 Clark Street, is contaminated with hexavalent chromium that is reaching the basements of some area residences and businesses through the ground water. Hexavalent chromium is extremely toxic, may cause cancer and can cause nervous system damage. The Regional Administrator and members of Congress were joined by Garfield Mayor Joseph Delaney, local officials and community members to review progress and discuss the ongoing Superfund cleanup at the former electroplating facility.

“The EPA has done a great deal of work since 2002 to reduce the health risks to the people who live and work in the area of Garfield affected by chromium contaminated ground water,” said EPA Regional Administrator Judith A. Enck. “Today we’re pleased to announce that we’re ready to take a step forward in the long-term cleanup of the Garfield Superfund site.”

Preliminary sampling shows that parts of the E.C. Electroplating building, its two basements and the soil located under the structure are contaminated with the chemical hexavalent chromium. The structure needs to be demolished in order to properly dispose of the contaminated sections of the building and to remove the contaminated soil underneath. The EPA tested the industrial materials left at the former E.C. Electroplating and will safely remove and properly disposed of them at licensed facilities.

The EPA is currently preparing the building for demolition by removing over 220 drums and cleaning the building surface. The agency will work closely with local officials to determine the best time to do the demolition and will hold a community meeting before demolition begins to inform area residents and building owners about the work. Strict procedures will be followed to control dust during the demolition, with special attention paid to the Garfield No.7 School and to a daycare center located near the site. The EPA will establish an air monitoring network to ensure that contamination is contained during the demolition work. The air monitoring plan will be shared with the public before work begins. The demolition work is presently scheduled to take place in October.

Ground water underlying the site is also contaminated with the hexavalent chromium and is seeping into basements in some Garfield homes and businesses. Drinking water for Garfield comes from the Garfield Municipal Water Supply, which is not contaminated and is routinely tested to ensure that it meets federal and state drinking water standards, which it does.

The Garfield Superfund site, which is located in a mixed commercial and residential neighborhood, is bordered by Van Winkle Avenue to the north, Monroe Street to the south, Sherman Place to the east, and the Passaic River to the West. Historically, industrial facilities in Garfield were located in close proximity to residential areas, including a tannery, a chemical plant and two electroplating companies. Some of these facilities used hexavalent chromium in their processes and the nearby ground water is now contaminated with the chemical. In June 1993, water containing hexavalent chromium and dried crystals of chromium was discovered in the basement of Garfield Fire House #3. In 2002, at the request of the New Jersey Department of Environmental Protection, the EPA began its investigation of ground water contamination in Garfield.

In September 2010, the federal Agency for Toxic Substances and Disease Registry issued a health advisory recommending that the EPA continue to take steps to minimize people’s exposure to the contamination and that it expedite a long-term cleanup. The site was added to the federal Superfund list in 2011.

The EPA used its Superfund’s emergency response authority in Garfield to address the immediate health threats in properties where ground water had carried hexavalent chromium into basements. Over 500 homes and businesses have been inspected for hexavalent chromium contamination and over 2,000 samples have been analyzed. The EPA has found about 15 properties that require cleanups to protect occupants from unacceptable levels of chromium that have seeped into their basements. The EPA has an ongoing inspection and assessment program to assist any concerned residents within the impacted area.

The EPA has established a network of ground water monitoring wells to determine the extent of chromium contamination in the ground water. This in-depth investigation will allow the EPA to determine how best to clean up chromium contaminated ground water.

Superfund is the federal cleanup program established by Congress in 1980 to investigate and clean up the country’s most hazardous waste sites. When sites are placed on the Superfund list, the EPA looks for parties responsible for the pollution and requires them to pay for the cleanups. In this instance, the EPA has identified E.C. Electroplating as a company that may be liable for the cleanup. The company, however, alleges it lacks funds to conduct any cleanup. To date, the EPA’s cleanup costs for this site exceed four million dollars. The EPA is continuing its search for other parties responsible for the contamination at the site.

Frelinghuysen today announced the completion of a system to treat contaminated ground water at the Rockaway Borough Wellfield Superfund site in Rockaway Borough, New Jersey. The officials were in Morris and Essex Counties to review and assess progress on Superfund cleanups at six hazardous waste sites. They were joined by State and local officials to highlight the success of the federal Superfund law in protecting the health of people who live and work near contaminated sites, creating jobs and boosting local economies.

Superfund is the federal cleanup program established by Congress in 1980 to investigate and clean up the country’s most hazardous waste sites. The Superfund program operates on the principle that polluters should pay for the cleanups, rather than passing the costs to taxpayers. When sites are placed on the Superfund list, the EPA looks for parties responsible for the pollution and requires them to pay for the cleanups. Cleanups are only funded by taxpayer dollars when those responsible for the pollution cannot be found or are not financially viable.

“Congressman Rodney Frelinghuysen and I got a first-hand look at how the ground water treatment system at the Rockaway Borough Wellfield site and other Superfund cleanups are protecting people’s health and the environment,” said EPA Regional Administrator Judith A. Enck. “Cleaning up toxic waste sites in New Jersey not only protects public health and the environment, but in 2011, federal Superfund cleanups created about 2,300 local jobs.

The Rockaway Borough Wellfield Superfund site includes three municipal water supply wells that supply drinking water to 11,000 people. The EPA recently completed work on a ground water treatment system to address perchloroethylene-contaminated ground water in the East Main Street/Wall Street area of the site. Perchloroethylene is a suspected cancer causing industrial solvent that can also cause short-term health effects such as respiratory distress and sore throats.

In 1985, the New Jersey Department of Environmental Protection investigated the Rockaway Borough site and concluded that contamination found in the municipal water supply was coming from multiple source areas within the borough. EPA initiated a followup investigation to identify the sources of contamination, determine its extent and evaluate potential cleanup methods. These investigations confirmed the perchloroethylene contamination and determined that a facility belonging to Klockner and Kockner was responsible for contaminating the soil with tetrachloroethene, a commonly used industrial solvent that can have serious health impacts, including liver damage and an increased risk of cancer. The EPA subsequently removed the contaminated soil and sent it to a facility certified to treat and dispose of it. The EPA installed a treatment system to clean up the ground water contamination. Work to remove and treat soil contaminated with lead at the Rockaway Borough site will begin later this year.    

Volatile organic compounds such as perchloroethylene and tetrachloroethene are a common concern at the sites visited on today’s Superfund tour. Many volatile organic compounds are known to cause cancer in animals and can cause cancer in people. The extent and nature of potential health effects depend on many factors, including the level and length of exposure.

Ground water, which collects underground in the spaces between dirt particles and cracks within rocks, flows underground and may empty into rivers, lakes or streams. Many people in New Jersey rely on ground water as the source of their drinking water. Public water supply systems are routinely tested to ensure compliance with federal and state drinking water standards, but contamination can make underground sources of drinking water unusable. To date, the cleanup has created 181 jobs and cost approximately $30 million.

In addition to Rockaway Borough, the other sites visited on the tour include:

The Radiation Technology, Inc. Superfund site in Rockaway Township is a 263-acre site that was used for testing and developing rocket motors and developing propellants. Ground water at the site is contaminated with volatile organic compounds. EPA is planning to excavate and remove pieces of deteriorated drums that were buried in a waste disposal area at the site to prevent them from further contaminating the surrounding soil with heavy metals. EPA's cleanup of the Radiation Technology site has been conducted in phases to facilitate the long-term restoration of the area. The work is being done by the company responsible for the pollution, Alliant Techsystems, with EPA oversight. During the first phase of the cleanup, the company installed wells to measure and monitor ground water contamination. Nearby residential drinking water wells were also sampled to ensure that drinking water was not affected. To date, the sampling has shown that the drinking water is not contaminated and monitoring of the residential wells continues. The second phase of the cleanup involved the removal and off-site disposal of the deteriorated drums. Continued sampling of residential wells has not found contaminated drinking water. To date, the cleanup has cost $4.3 million.

The Rockaway Township Wells Superfund site, located in Rockaway Township, is a two-square-mile wellfield containing a cluster of three municipal wells within 100 feet of each other that are contaminated with various volatile organic chemicals. A cleanup plan called for the treatment of the contaminated ground water and the replacement of the township’s air stripper, which forces air through polluted ground water to remove harmful chemicals. The air causes the chemicals to change from a liquid to a gas, which is then collected and cleaned. Sampling of several buildings revealed that chemical vapors were impacting the indoor air quality of some buildings on the site. To address these problems, a system was subsequently installed in two buildings to prevent soil vapors from entering them. Two of the public water supply wells have been taken out of service and water from the other is treated to remove the contamination and provide the community a safe source of drinking water.  

The Dayco Corp./L.E. Carpenter Company Superfund site is located in the Borough of Wharton. This 14.5-acre property housed buildings, warehouses and the remnants of disposal areas associated with a former vinyl wall covering manufacturing facility. The soil and ground water were contaminated with volatile organic compounds, lead and PCBs. The initial $26 million cleanup included the removal of 16 storage tanks, demolition of the various former manufacturing buildings and excavation of more than 46,000 tons of contaminated soil and liquid industrial waste. Residual volatile organic compound contamination in the ground water and a small area of soil are currently being addressed. All cleanup activities have been funded by the party responsible for the contamination. To date, the cleanup has cost approximately $26 million.
The Dover Municipal Well No. 4 Superfund site is a former public water supply well located in the town of Dover. The ground water is contaminated with volatile organic compounds. The well is not in service, but it is located 1.5 miles away from three municipal wells serving approximately 22,000 people. The EPA demolished a building formerly occupied by a dry cleaner, excavated and disposed of over 2,100 cubic yards of contaminated soil, and treated the remaining contaminated soil and shallow ground water to remove harmful chemicals. The EPA also tested nearby homes built above the contaminated ground water to ensure that vapors were not entering the houses. Soil sampling conducted at the site determined that three houses were situated in very close proximity to the contaminated material and were in such a poor structural condition that they needed to be demolished. The acquisition of these houses and relocation of the tenants was completed in August 2008. Ground water samples taken during the treatment process have demonstrated that the technology is effective. The EPA will continue monitoring to ensure that concentrations of ground water contamination are decreasing. To date, the cleanup has cost approximately $16 million.

The Caldwell Trucking Co. Superfund site is a former sewage hauling site occupying 11 acres in Fairfield. The Caldwell Trucking site consists of properties and ground water contaminated by the disposal of residential, commercial and industrial septic waste. Caldwell Trucking disposed of this waste in unlined lagoons from the early 1950s until 1973. After 1973, Caldwell installed underground storage tanks for the storage of the waste. Other industrial facilities in the area may also have contributed to the ground water contamination. The parties potentially responsible for the cleanup removed the contaminated soil and sludge from the lagoons and installed wells to monitor ground water quality. All contaminated soil has now been removed or no longer poses a risk and impacted wetlands have been restored.

There are about 500 single family homes located in a populated area within one mile of the site. Since 1981, over 300 private wells in the area have been taken out of service due to contamination. The affected residences have been connected to the municipal drinking water supply system. A system of pumps is used to bring the polluted ground water to the surface where it can be cleaned. In addition, testing of about 100 homes showed that in about 18 homes chemical vapors were impacting the indoor air quality. To address the problem, systems were installed in these homes to prevent these vapors from building up to harmful levels. To date, the cleanup has cost approximately $32 million.

At all sites at which ground water is contaminated, the EPA requires periodic collection and analysis of ground water samples to verify that the level and extent of contaminants are declining and that people’s health and the environment are protected. The EPA also conducts reviews every five years to ensure the effectiveness of the cleanups.

(New York, N.Y. – July 12, 2012) The U.S. Environmental Protection Agency is proposing to change a portion of its plan to build two separate systems to treat contaminated ground water at the Liberty Industrial Finishing Superfund site in Farmingdale, New York. Between 1940 and 1978, various industrial operations took place at the site including aircraft parts and fiberglass products manufacturing and metal plating and finishing. Hazardous substances including cadmium, chromium and trichloroethene were disposed of in unlined basins and other areas on the site. One portion of the ground water under the site was contaminated by activities at the site itself, and another portion was believed to be contaminated by activities at the nearby Farmingdale Plaza Cleaners. The two separate areas of ground water at the 30-acre former industrial park were contaminated by volatile organic compounds, which can cause serious damage to people’s health and the environment. In 2002, the EPA issued a plan to install two separate systems to treat the portion of ground water contaminated by the manufacturing facility and the portion contaminated by the dry cleaner site. The system to treat contamination from the Liberty Industrial site was constructed and is currently operating. EPA is proposing to not build the second system because the dry cleaner site is being cleaned up by the New York State Department of Environmental Conservation and recent monitoring data shows that the contamination levels in the portion of ground water under the Liberty Industrial site that was contaminated by the dry cleaner site have dropped significantly. The EPA is also announcing a change in restrictions on the future use of a portion of the site to allow recreational use of that area.

The EPA will hold a public meeting on July 26, 2012 at 7:00pm to explain the proposed plan at the Farmingdale Library, 116 Merrits Road, Farmingdale. Comments will be accepted until August 20.

In December 2002, the New York State Department of Environmental Conservation began work to clean up the Farmingdale Plaza Cleaners site under the state’s Superfund program. At that time, the EPA requested that the state also cleanup the ground water contamination underneath the Liberty Industrial site that was caused by the dry cleaner site. Since 2002, monitoring data has found that ground water contamination levels from the dry cleaner site have declined to near drinking water standards. Based on the monitoring data and the state’s plan to address the ground water as part of its work to clean up the dry cleaner site, the EPA no longer plans to build the second ground water treatment system at the Liberty Industrial Finishing site. The EPA will require periodic ground water sampling to verify that the level and extent of contaminants are declining and that people’s health and the environment continue to be protected.

The EPA is also announcing a change in restrictions on use of a portion of the site that has already been cleaned up. The original 2002 cleanup plan stated that a 7.5-acre portion of the site known as the Central Sub-Parcel could be used only for commercial or industrial activities after the cleanup. The Town of Oyster Bay, however, has since then acquired the 7.5-acre portion of the site for further expansion of the Ellsworth Allen Park, and has undertaken additional cleanup at the Central Sub-Parcel. After assessing the cleanup that has been completed at the site, the EPA has concluded that the Central Sub-Parcel is suitable for redevelopment with clearance for recreational use.

EPA has overseen a comprehensive cleanup of the Liberty Industrial Finishing site including:

  • Excavation and disposal off-site of 70,000 cubic yards of contaminated soil
  • Removal of contaminated water and solid material from vaults and sumps under ground
  • Removal of underground storage tanks
  • Construction and ongoing operation of a system to treat the ground water contaminated by former industrial activities at the site
  • Excavation and disposal off-site of 4,200 cubic yards of contaminated pond sediment at the Massapequa Preserve.

Cleanup Brings Muskegon Lake Area of Concern Closer to Restoration, Delivers Results Under Great Lakes Initiative

CHICAGO (May 14, 2012) - The U.S. Environmental Protection Agency, Michigan Department of Environmental Quality and the City and County of Muskegon today announced the completion of a contaminated sediment removal project at the Division Street Outfall to Muskegon Lake.  This project brings Muskegon Lake closer to being removed from a binational list of Areas of Concern in the Great Lakes.  

"The work by federal, state, county, city and other partners over the years has helped deliver real results under the Great Lakes Restoration Initiative," said Cameron Davis, Senior Advisor to the EPA Administrator.  “This work will help boost human, ecological and local economic health. But we can’t stop here. We’re looking for new partners to match funds to accelerate cleanups in other Areas of Concern in Michigan and around the Great Lakes."

The $12 million project under the Great Lakes Restoration Initiative’s Legacy Act removed about 43,000 cubic yards of sediment contaminated with mercury and polycyclic aromatic hydrocarbons, or PAHs.  The contamination contributed to limits on eating fish caught in the lake, as well as loss of habitat and other environmental problems.

“The State of Michigan is excited to work with the EPA Great Lakes Legacy Act in cleaning up our Areas of Concern. We appreciate the time and effort of the local partners in restoring the values of the Muskegon Lake area to the local community,” said Patty Birkholz, Director of the Office of the Great Lakes.

The Muskegon Lake Area of Concern includes the entire lake, which is separated from Lake Michigan by sand dunes and a navigation channel. The Muskegon River flows through the lake before emptying into Lake Michigan. Additional tributaries include Mosquito Creek, Ryerson Creek, Ruddiman Creek, Green Creek, and Four Mile Creek.  In the 1980s, the U.S. and Canada identified 43 highly degraded shoreline areas along the Great Lakes.  Today there are 30 AOCs wholly in the U.S. or shared with Canada.

The Great Lakes provide more than 30 million Americans with drinking water and underpin a multi-billion dollar economy.  In February 2009, President Obama proposed the GLRI, the largest investment in the Great Lakes in two decades.

The GLRI Action Plan, which covers FY 2010 through 2014, was developed by a task force of 16 federal departments and agencies to implement the president’s historic initiative.  It calls for aggressive efforts to address five urgent priority focus areas:

- Cleaning up toxics and toxic hot spot areas of concern.
- Combating invasive species.
- Promoting near-shore health by protecting watersheds from polluted runoff.
- Restoring wetlands and other habitats.
- Raising public awareness, tracking progress and working with partners.

The plan also ensures accountability by establishing measures of progress and benchmarks for success.

SAN FRANCISCO – The U.S. Environmental Protection Agency and the U.S. Department of Energy’s National Renewable Energy Laboratory (NREL) have developed and launched new tools designed to test underutilized sites and contaminated land for solar and wind energy potential. The tools give local communities and landowners ways to evaluate sites for renewable energy potential without the need for technical expertise.
 The alternative energy ‘decision trees,’ leverage NREL’s knowledge of renewable energy technologies and EPA’s experience in returning contaminated lands to productive use.

 The EPA estimates that nationwide there are approximately 490,000 sites and almost 15 million acres of potentially contaminated properties.

 “Opportunities to install renewable energy systems on vacant properties can be found in every community," said Jared Blumenfeld, EPA’s Regional Administrator for the Pacific Southwest. “Tapping sun and wind power at brownfield sites, rooftops, parking lots, and abandoned land could provide untapped gigawatts of clean energy.”

The City of Richmond, Calif. is serving as a pilot community for development of the tools.
“Developing more local renewables is among my top priorities,” said Richmond Mayor Gayle McLaughlin. “We are extremely excited that the green, innovative City of Richmond, California is partnering with the EPA to help communities throughout the United States fully leverage technology to improve the environment, create local jobs and attract green companies.”

Positioning renewable energy on sites can increase economic value of the properties, provide a sustainable land reuse option, create local green jobs and provide clean energy for use on-site or for the utility grid. Using the decision trees, state and local governments, site owners and community members can help identify the most desirable sites for solar or wind installations from both a logistical and economic standpoint.
In addition to opportunities in cities, thousands of potentially contaminated acres in less populated areas across the country could be put to beneficial reuse with renewable energy.

The tools can be used to evaluate individual or multiple sites, such as brownfields, Superfund and other hazardous waste sites, abandoned parcels, landfills, parking lots, and commercial or industrial roofs, depending on the technology.

EPA Funding Available for Study of Raritan River in NJ

(New York, N.Y. – March 13, 2012) The U.S. Environmental Protection Agency is encouraging applications for $100,000 in funding to study contaminated sites and other sources of pollution that are impacting water quality in the lower and middle Raritan River. This funding is part of an EPA Raritan River Initiative, which will support the analysis of existing data to enable environmental agencies, institutions, community groups and local governments to identify data gaps, plan future research and make other environmental decisions.

The Raritan River runs from west of Somerville, N.J. into the Raritan Bay. The river and the surrounding watershed is home to over one million people, providing drinking water, transportation and recreation opportunities and important habitat for wildlife. The watershed is impacted by many sources of pollution, including contaminated sites, industrial facilities and sewage treatment systems. While there is sampling data collected within the Raritan River watershed, this information is fragmented.

“This funding demonstrates the EPA's continued commitment to a cleaner and healthier Raritan River and the health of everyone who enjoys it," said EPA Regional Administrator Judith A. Enck. "The data and information collected will help Raritan River communities better understand pollution that has affected river conditions and will assist in decision-making on the best ways to improve water quality.”

Using the funding, the selected applicant will identify high priority sites and sources of pollution that are potentially impacting the river. The resulting site list and associated data will then be made available to the public and put into a format that can be used by state agencies, country and local governments, non-profit organizations and other stakeholders to make environmental decisions. The data would also be used to create an interactive website to show exact locations of potentially polluting sites along the river along with the data for each site.

Cleanup Brings Milwaukee Area of Concern Closer to Restoration

Cleanup Brings Milwaukee Area of Concern Closer to Restoration, Delivers Results Under Great Lakes Initiative
  
CHICAGO (Feb. 17, 2012) - The U.S. Environmental Protection Agency, Wisconsin Department of Natural Resources and Milwaukee County today announced completion of contaminated sediment removal in Lincoln Creek and the Milwaukee River Channel.  This project brings the Milwaukee Estuary closer to being removed from a binational list of Areas of Concern in the Great Lakes.  

"The work by state, county, city and other partners over the years has helped deliver real results under the Great Lakes Restoration Initiative," said Cameron Davis, Senior Advisor to the EPA Administrator.  “Thousands of cubic yards of harmful contaminated sediment were removed to help boost human, ecological and local economic health. But we can’t stop here. We’re looking for new partners to match funds to accelerate cleanups in other Areas of Concern in Wisconsin and around the Great Lakes."

The $24.6 million project under the Great Lakes Restoration Initiative’s Legacy Act removed about 140,000 cubic yards of sediment contaminated with polychlorinated biphenyls and polycyclic aromatic hydrocarbons, or PCBs and PAHs.  The contamination led to limits on eating fish caught in the river, as well as loss of habitat and other environmental problems. 

“The Great Lakes are the largest source of fresh water in the world.  Keeping them clean for the future is a priority,” said WDNR Secretary Cathy Stepp, “We are making major strides cleaning up the Milwaukee River Estuary.  I am pleased that we were able to fund most of the non-federal cost share for this project from state bonding, and delighted at the level of public support this project has received.  With our partners we will continue to work to bring the Milwaukee River back to provide recreational and economic benefits for the Milwaukee area." 

GLRI Legacy Act funds covered about $16 million.  WDNR contributed roughly $8.6 million.  The result was the cleanup of the largest known deposit of PCB-contaminated sediment in this Area of Concern. 

“This joint effort demonstrates the tangible benefits that can come from cooperation between all levels of federal, state and local government. By working together we are removing the impairments to our waterways that resulted from our long industrial history,” said Milwaukee County Executive Chris Abele.  “This significant portion of the Milwaukee River and its natural resources are now cleaner, safer and more sustainable. We embrace the triumphant return of this park land to the greater use and enjoyment of our citizens.”

The Milwaukee River section of the Area of Concern extends from Cedar Creek downstream through the Outer Harbor. It includes Cedar Creek, Lincoln Creek and portions of the Menomonee, Little Menomonee and Kinnickinnic rivers.  In the 1980s, the U.S. and Canada identified 43 highly degraded shoreline areas along the Great Lakes.  Today there are 30 AOCs wholly in the U.S. or shared with Canada.

The Great Lakes provide 30 million Americans with drinking water and underpin a multi-billion dollar economy.  In February 2009, President Obama proposed the GLRI, the largest investment in the Great Lakes in two decades. 




The Action Plan, which covers FY 2010 through 2014, was developed by a task force of 16 federal departments and agencies to implement the president’s historic initiative.  It calls for aggressive efforts to address five urgent priority focus areas:
•Cleaning up toxics and toxic hot spot areas of concern.
•Combating invasive species.
•Promoting near-shore health by protecting watersheds from polluted runoff.
•Restoring wetlands and other habitats.
•Tracking progress, education and working with strategic partners.

The plan also ensures accountability by establishing measures of progress and benchmarks for success.

EPA Seeks Public Input on Plan for Cleanup at
American Cyanamid Superfund Site in Bridgewater Township, N.J.

(New York, N.Y. - Feb. 16, 2012) The U.S. Environmental Protection Agency has proposed a cleanup plan for contaminated soil, ground water and six waste disposal areas at the American Cyanamid Superfund Site in Bridgewater Township, New Jersey, located on the Raritan River. The soil, ground water and waste disposal areas, called impoundments, are contaminated with volatile organic compounds and other hazardous materials. The ground water underlying the site is highly contaminated with benzene. Area residents are serviced by a public water supply that provides a safe source of drinking water.

The EPA is encouraging the public to comment on the plan through March 31, 2012 and will hold a public meeting on March 8, 2012 at 7:00 PM at the Somerset County Vocational and Technical High School, 14 Vogt Drive, Bridgewater, New Jersey.

"The cleanup plan for the American Cyanamid site is an important milestone in the EPA efforts to protect the health of people who live or work near the facility and water quality in the Raritan River," said EPA Regional Administrator Judith A. Enck. “EPA encourages the public to comment on the proposed plan and to learn more about it at the March 8 public meeting.”

Many volatile organic compounds are known to cause cancer in animals and benzene can cause cancer in people. Some volatile organic compounds have no known health effects. The extent and nature of potential health effects depend on many factors, including the level and length of exposure.

The American Cyanamid Superfund site has a history of industrial pollution dating back to 1915. For nearly 100 years, prior owners used the location for manufacturing chemicals. The site was placed on the federal Superfund list in 1983 after hazardous chemicals were found in the soil and ground water. The 435-acre Superfund site contained various areas used for the disposal of chemical sludge and other waste. In 1998, the EPA deleted 140 acres of the site from the Superfund list after they were evaluated and determined to be acceptable for redevelopment. The TD Bank Ballpark Stadium was subsequently built on a portion of the area. In 2009, Pfizer Inc. assumed responsibility for the American Cyanamid site as part of its purchase of the Wyeth Holding Corporation, a prior owner.

Because of the nature and complexity of the contamination at the site, the EPA divided the investigation and cleanup into phases. The plan announced today is the first phase of the cleanup. The proposed plan announced today details approaches to address contaminated soil, ground water and six waste disposal areas (Impoundments 3, 4, 5, 13, 17 and 24). Two additional impoundments (Impoundments 1 and 2) are the focus of a separate study to consider the feasibility of options to address them.

The highly toxic material in Impoundments 3, 4, and 5 will be treated at their current locations by introducing a mixing agent into the waste to make it more solid. This treatment method is a proven technology that immobilizes contaminants to prevent their migration. After this step, the waste disposal areas will be covered with a barrier system that traps vapors and prevents contaminated air from escaping into the atmosphere.

The soil at the site will be addressed using three different methods depending on the extent of the pollution in the soil. Soil that consists of tarry material or is highly toxic, similar to the waste within Impoundment 3, 4, and 5, will be excavated and combined with the material in the three impoundments. It will be treated with the existing waste in Impoundments 3, 4 and 5. Soil that contains volatile and semi-volatile organic compounds will be covered with a vapor control barrier and mitigation system to prevent the release of vapors into the air. Soil that has a lower level of pollution will be covered by a 24-inch thick engineered cap that will serve as a barrier that prevents direct contact. Additionally, the EPA will conduct an ecological study of the waste in Impoundments 13, 17 and 24, which are located in the flood plain of the site, to determine the appropriate treatment for these materials.

A currently operating ground water collection system, which has already treated millions of gallons of contaminated ground water at the site, will be improved by relocating the primary extraction wells to a more central location. Several new extraction wells will be added to enhance the efficiency of the ground water collection system. In addition, a recovery system for collecting and treating shallow contaminated ground water from portions of the site will be constructed at several locations. This system will prevent contaminated ground water from seeping into the Raritan River, Cuckhold’s Brook and Middle Brook. The details of these improvements will be developed during the remedial design phase of the cleanup project.

The proposed plan also calls for the placement of controls such as legal restrictions on land use to minimize the potential of future exposure and to ensure that the cleanup measures are not disturbed. Throughout the cleanup, monitoring will be conducted to ensure the effectiveness of the remedy. The EPA will conduct periodic reviews to ensure that the cleanup remains protective of public health and the environment.

$10 Million Settlement with Mining Company

    U.S. EPA, Dept. of Justice reach $10 Million settlement with Department of the Interior, Northern California mining company for cleanup costs and transfer of land to Elem Indian Colony


SAN FRANCISCO -- The U.S. Environmental Protection Agency has finalized a multi-party agreement to settle cleanup costs for seven mining sites in three states. The parties to the agreement include the U.S. Department of the Interior, the U.S. Forest Service, the Bradley Mining Company, the Worthen Bradley Family Trust and the Elem Indian Colony of Pomo Indians.

Under the settlement, the Bradley Mining Company and Bradley Trust will transfer nearly all of their land holdings at the Sulphur Bank Mercury Mine to a new trust created to retain the lands pending EPA cleanup. The Elem Indian Colony will receive approximately 380 acres of uncontaminated land - adding to its current holdings of 50 acres - as compensation for natural resource damages from mining operations by the Bradley Mining Company.     


Nearly $7 million in federal funds will be used to reimburse EPA’s costs for cleaning up contamination at the Elem Indian Colony and the access road to the Colony.


“This significant settlement took three years to hammer out. The result is a win for Clear Lake and a win for the Elem Colony,” said Jared Blumenfeld, Regional Administrator for EPA’s Pacific Southwest region. “This settlement will help the Clear Lake ecosystem recover, including reducing the risks due to mercury in fish. It also demonstrates EPA’s strong commitment to supporting the environmental cleanup of tribal lands.”


In addition to the land transfers relating to the Sulphur Bank Mine, the proceeds from insurance policies and any future income from the Bradley Mining Company will be divided among the seven mine sites for future cleanup, with the Bradley Mining retaining a share of the proceeds.


The Sulphur Bank Mercury Mine Superfund Site is located at the southeastern end of the Oaks Arm of Clear Lake. The site includes the Elem Indian Colony which is located directly adjacent to the mine property. The site initially was mined for sulfur from 1865 to 1871. Mercury ore was mined intermittently by underground methods from 1873 to 1905, and open-pit mined from 1915 to 1957. The mine, once one of the largest producers of mercury in California, has been inactive since 1957.


Approximately three million cubic yards of mine wastes and tailings remain on the mine site. Mercury is present in the bottom sediments in Clear Lake, and mercury has bio-concentrated in the food chain of Clear Lake. The levels of mercury in fish from the lake led the State to issue an advisory to limit consumption of fish. Clear Lake is the source of water that the Clear Lake Oaks Water District provides for municipal drinking water for 4,700 people.


This cleanup effort is one of several tribal land cleanups in the Pacific Southwest Region. EPA is currently overseeing the investigation and clean up of contamination on Hopi and Navajo lands throughout the southwest.

Dredging of Contaminated Sediment to Begin

Dredging of Contaminated Sediment in New Jersey's Passaic River to Begin


As attested to by the large amounts of contaminated sediment present in its channel, New Jersey’s Passaic River has long been home to significant industrial activity.  This contamination is particularly acute in the final 17 miles of the river, from Dundee Dam, in Garfield, to the river’s confluence with Newark Bay.  In an effort to address one of the waterway’s most contaminated locations, dredging is scheduled to begin this spring in a section of the river in Newark that adjoins the site of a former pesticide manufacturing facility known to have released large amounts of the toxic compound dioxin into the river.

The section of the river that is to be dredged is included within the Diamond Alkali Superfund Site, a federally designated area that encompasses the Neward plant site, the final 17 miles of the Passaic and its tributaries, and portions of Newark Bay.  The Superfund site is named after the Diamond Alkali Company, which owned and operated the Newark plant from 1951 to 1969.  (Diamond Alkali was later known as the Diamond Shamrock Chemicals Company.)

Dioxin, a by-product of pesticide manufacture, has been found at high levels at the site of the former manufacturing facility, which is approximately 3 miles upstream of the mouth of the Passaic.  Over time significant quantities of dioxin entered the river, which, because of the tidal influence, carried the contamination upstream as well as downstream.  Under the terms of the federal Superfund law (formally, the Comprehensive Environmental Response, Compensation, and Liability Act), the Occidental Chemical Corporation – a subsidiary of Occidental Petroleum Corporation, of Dallas – has taken on the liabilities from the operations of the Diamond Shamrock Chemicals facility as a result of its purchase of the liabilities from the Diamond Shamrock Corporation, now known as the Maxus Energy Corporation, of The Woodlands, Texas.  Therefore, Occidental Chemical is legally responsible for remediating the contamination caused by the former manufacturing plant.  However, Maxus Energy has contractual responsibilities through an indemnification agreement with Occidental Chemical to perform remedial activities on the latter’s  behalf.  Meanwhile, a subsidiary of Maxus Energy – Tierra Solutions, Inc., of East Brunswick, New Jersey – is overseeing the financing, design, and construction activities related to the continuing effort to remove contaminated material from the Passaic.  ARCADIS/Malcolm Pirnie, of Highlands Ranch, Colorado, is the principal design firm and general contractor for Tierra Solutions.
