U.S. EPA Fines Kettleman City Landfill for Improper Analysis of PCBs Waste
LOS ANGELES—The U.S. Environmental Protection Agency today fined Chemical Waste Management, Inc. (CWM) $9,375 for a single instance in which it failed to analyze leachate for polychlorinated biphenyls (PCBs) before disposal at its Kettleman Hills Facility located in Kings County, Calif.
On May 9, 2012, CWM voluntarily disclosed to EPA that leachate, or liquid that drains from a landfill, was disposed in a hazardous waste surface impoundment without being sampled or analyzed for PCBs. The leachate remaining in the tank was later tested for PCBs and found to be below the regulatory limit 50 milligrams per liter, allowing it to be placed into the surface impoundment.
In addition to paying the fine, CWM will implement new safety protocols for its leachate collection tanks to ensure that the leachate is properly sampled for PCBs before removal from the tanks —preventing the mismanagement of this liquid in the future. The new protocols consist of additional equipment tagging and a detailed documentation process.
There is no evidence to suggest that the landfill’s violation posed any danger to nearby communities or workers at the facility.
Prior to 1976, PCBs were commonly added to liquids used in electrical transformers, capacitors, circuit breakers, voltage regulators/switches, plasticizers, and other additives in lubricating and cutting oils. EPA regulates PCBs under the Toxic Substances Control Act. EPA will continue to monitor this facility and other PCB storage and disposal facilities.

EPA Extends Public Comment Period on Plan for the Cornell-Dubilier Electronics Superfund site in South Plainfield, New Jersey

(New York, N.Y. – August 20, 2012) The U.S. Environmental Protection Agency is extending by thirty days the public comment period for the plan it has proposed for the contaminated ground water at the Cornell-Dubilier Electronics Superfund site in South Plainfield, New Jersey. The plan would prevent the use of contaminated ground water as a source of drinking water. The ground water associated with the site, located at 333 Hamilton Boulevard in South Plainfield, became contaminated with polychlorinated biphenyls (PCBs) and volatile organic compounds from past industrial activities. PCBs are likely cancer causing chemicals and can have serious neurological effects. Volatile organic compounds can cause serious damage to people’s health.

The ground water at the Cornell-Dubilier Electronics site is contained within underground layers of rock and soil. Municipal water supply wells in Middlesex County draw ground water from some portions of the rock formations to the north of the site. The plan proposed in July will require enhanced and continued monitoring of the ground water and will prevent the contaminated site ground water from being used as a source of drinking water in the future. The Cornell-Dubilier Electronics Superfund site is part of a Borough of South Plainfield redevelopment area.
The EPA held a public meeting on August 7, 2012 to explain the proposed plan. At the request of a member of the public, the agency is extending the public comment period from its original date of August 20 to a new public comment deadline of September 20, 2012.

Cornell-Dubilier Electronics, Inc., manufactured electronics parts at the 26-acre facility from 1936 to 1962. PCBs and solvents were used in the manufacturing process and the company disposed of PCB-contaminated materials and other hazardous wastes at the facility property.

Superfund Efforts to Clean Waterways Come With a Risk

LYNDHURST, N.J. — This is not what a Superfund site is supposed to look like. There are no rusting barrels, no antifreeze-green slime oozing up from the ground. There’s just a deep bend in the serpentine Passaic River, a gaggle of pushy Canada geese and a lone rower in a single scull making good time on the calm, dark waters.

Yet Mile Marker 10.9 on the Passaic is most definitely a toxic hot spot. Testing late last year showed that five acres of shallow mud flats in the river here were highly contaminated with mercury, toxic chemical compounds called PCBs and dioxin, which is known to cause cancer. The discovery has sent environmental officials and a small army of corporations scrambling to remove thousands of cubic yards of sediment with plans to seal the rest beneath a permanent cap, all within the coming year.

That the hidden dioxin deposit was detected at all and the remediation put on such a fast track are results of an ambitious effort by the Environmental Protection Agency, which runs the federal Superfund program, to zero in on toxic targets that had been passed over for decades because they were too big, too costly and just too difficult to tackle.

More than three decades after the program was established by Congress to clean up the most heavily polluted sites in the country, either by forcing those responsible to pay or by covering the cost with money from a special fund, the agency is now taking on the most expensive and most technically complex cleanups ever attempted — large stretches of urban waterways where the pollution is out of sight.

But there are lingering doubts about the best ways to handle such immense cleanups. “The public wants this stuff picked up and hauled away,” said Michael A. Barbara, the technical consultant for the businesses that are being held responsible for cleaning up the Passaic. “But the reality is that sometimes the process of stirring up this stuff does more harm than leaving it in place.”

Even the most notorious hazardous-waste dumps on land pale beside the prospect of cleaning up miles of riverbed — in which the slightest movement can stir up long-buried wastes that tides, floods, even motorboat traffic can spread upstream and down. Trying to predict how everything will work is so complicated that preliminary planning alone can cost more than an entire land-based cleanup.

But after years of study and some smaller pilot projects that met with varying degrees of success — and failure — the E.P.A. is finally tackling some of the most heavily polluted waterways. Many are in the New York-New Jersey area, which, since the beginning of Superfund, has had the greatest number of polluted sites.

EPA Proposes to Renew US Ecology’s PCB Landfill Permit; Public Comment Period Begins

SAN FRANCISCO – Today the U.S. Environmental Protection Agency (EPA) is soliciting comments on its proposed PCB permit for US Ecology, Inc., a hazardous waste management facility located outside Beatty, Nevada. EPA’s proposed permit will allow US Ecology to continue commercial storage, treatment and disposal of PCB wastes. The company has disposed of PCBs at this location since 1978.
The 45-day comment period begins August 10 and ends September 24. The EPA is hosting an informational Public Meeting and Hearing on September 13 from 6:00 - 8:00 pm at the Beatty Community Center located at 100 A Avenue South in Beatty, Nevada.
Production of PCBs was banned in the United States in 1979. PCBs remain present in some products and materials produced before the 1979 ban. Products that may contain PCBs include: electrical transformers and capacitors, other electrical equipment, and fluorescent light ballasts. EPA regulates the treatment, storage and disposal of PCBs under the Toxic Substances Control Act.

(New York, N.Y. – July 20, 2012) The U.S. Environmental Protection Agency is proposing a plan for the contaminated ground water at the Cornell-Dubilier Electronics Superfund site in South Plainfield, New Jersey that will prevent its use as a source of drinking water. The ground water associated with the site, located at 333 Hamilton Boulevard in South Plainfield, became contaminated with polychlorinated biphenyls (PCBs) and volatile organic compounds from past industrial activities. The ground water at the Cornell-Dubilier Electronics site is contained within underground layers of rock and soil. The EPA will hold a public meeting on Tuesday August 7, 2012 at 7 p.m. to explain the proposed plan and is encouraging public comments. The meeting will be held at the South Plainfield Senior Center located at 90 Maple Avenue, South Plainfield. Comments will be accepted until August 20, 2012.
Cornell-Dubilier Electronics, Inc., manufactured electronics parts at the 26-acre facility from 1936 to 1962. PCBs and solvents were used in the manufacturing process and the company disposed of PCB-contaminated materials and other hazardous wastes at the facility property.

Because of the nature and complexity of the contamination at the site, the EPA divided the investigation and cleanup into four phases. The proposed plan announced today is for the third phase of the long-term cleanup.

Under the first phase of cleanup, which is continuing, the EPA has cleaned up nearby residential, commercial, and municipal properties. PCB-contaminated soil has been removed from four residential properties near the former facility property. EPA has since identified eight additional properties and expects to begin to clean up these properties in August 2012. This work will be completed before the winter. Investigations are still being performed on several other properties as part of this phase of the cleanup.

Under phase two of the cleanup, the EPA cleaned up the contaminated buildings and soils at the former facility property. EPA has demolished 18 contaminated buildings and removed 26,400 tons of building debris off-site to be disposed of properly. The EPA has also excavated approximately 21,000 tons of contaminated debris and soil from an undeveloped area of the facility. Using $30 million in American Recovery and Reinvestment Act funds, the EPA continued the second phase of cleanup by treating contaminated soil on-site using a technology that heats the material so that contaminants can be pulled out and captured. Soil that could not be cleaned using this method was taken off-site for disposal at a licensed facility.

The third phase of the long-term cleanup, and the phase that is the subject of the proposed plan announced today, focuses on the contaminated ground water. After extensive soil and ground water studies, the EPA has concluded that it is not feasible to treat the contaminated site ground water because of the complex rock formations underlying the site. The depth, nature and variety of the rock formations would present extreme technical challenges for any active treatment. The EPA is proposing to install additional ground water monitoring wells to monitor the ground water and to put into place restrictions that will prevent the use of untreated ground water as drinking water. In addition, the EPA’s plan calls for periodic sampling to ensure that potentially harmful vapors from the contaminated ground water do not seep into nearby buildings. Recent periodic indoor air testing inside nearby buildings shows that vapors are not currently getting into the structures.

In the fourth and final phase of the long-term cleanup, the EPA will focus on the contaminated sediment of the Bound Brook. The potential for ground water contamination to impact surface water and sediment in the Bound Brook is also being evaluated as part of this phase. A cleanup plan for phase four is expected in 2013.

The Superfund program operates on the principle that polluters should pay for the cleanups, rather than passing the costs to taxpayers. After sites are placed on the Superfund list of the most contaminated waste sites, the EPA searches for parties responsible for the contamination and holds them accountable for the costs of investigations and cleanups. To date, the EPA’s cleanup costs for this site exceed $133 million. The EPA will seek to recover some of its costs from the parties responsible for the contamination.

U.S. EPA to dispose of PCB waste from leaking Guam Power Authority transformers
Old large electrical transformers located at Apra Heights and Talofofo Substations

HONOLULU – The U.S. Environmental Protection Agency will be conducting work to remove polychlorinated biphenyl (PCB) oils from old leaking electrical transformers stored at the Guam Power Authority’s Apra Heights and Talofofo Substation facilities.

EPA Region 9’s Emergency Response staff will be working with GPA and Guam EPA to drain the PCB oil from the transformers, clean the insides of the transformers, and package the PCB waste for shipment and transport to the U.S. mainland for proper disposal.  In addition, soil sampling will be performed to determine if there is any soil contamination from the leaking transformers.

Two large transformers, one at Apra Heights and one at Talofofo each have about 3000 gallons PCB cooling oil and were found leaking. The transformers are stored inside of a fenced and secured outdoor spill containment area at the substations. It is unknown how long the transformers have been leaking, but GPA has plans to repair and reuse the transformers once they are drained of the PCB oil and refilled with non-PCB cooling oil. 

Other smaller transformers with PCB oil located at a GPA storage location in Dededo will also be drained and cleaned.  All of the transformers are stored outside, subject to the weather and elements.

PCBs were manufactured in the United States from 1929 until 1979 when their manufacture was banned.  The chemical has been used as coolants and lubricants in transformers, capacitors and other electrical equipment because of their insulating properties.  PCBs do not readily break down in the environment and bioaccumulate in the food chain. The chemical has been determined to be a probable human carcinogen and the most commonly observed health effects in those exposed to the PCB oil are skin conditions such as acne and rashes. Other health effects may include effects on the immune system, reproductive system, nervous system, and endocrine system.

EPA to Conduct First Five-Year Review of Hudson River PCB Cleanup

(Fort Edward, N.Y. – March 30, 2012) The U.S. Environmental Protection Agency is currently conducting a five-year review of the cleanup that has been conducted so far on the Hudson River PCBs Superfund site, which extends from Hudson Falls, New York, to New York City. The cleanup work is being performed in the Upper Hudson River north of Troy, New York. The purpose of this five-year review, which is legally required under the Superfund law within five years after the start of on-site construction, is to ensure that the cleanup is working as intended and continues to protect public health and the environment.

In conducting the five-year review, the EPA is reviewing site operation, maintenance and monitoring information. The plan for dredging underwent extensive review by the EPA and the General Electric Company at the end of the 2009 dredging program. The dredging was also reviewed by a panel of independent scientific experts at that time. The results of that evaluation will be summarized in this five-year review and will be supplemented with information gathered during the 2011 dredging season. The five-year review will also include a review of the 1984 cleanup plan for the areas of PCB-contaminated sediment upstream of the areas targeted for dredging. These areas, known as the remnant deposits, became exposed after the river water level dropped following removal of the Fort Edward Dam in 1973.

Between 1947 and 1977, an estimated 1.3 million pounds of PCBs were discharged into the river from two General Electric capacitor manufacturing plants located in Fort Edward and Hudson Falls, New York. The dredging of the Hudson River was designed to occur in two phases. The first phase of the dredging project was conducted in 2009 and the second and final phase began in June 2011. The cleanup is being conducted by General Electric Company under a legal agreement with the EPA.

Under the law, the ongoing five year review of the Hudson River dredging project must be completed by the end of April 2012. The results will be shared with the public and will be available on the EPA’s Hudson River website at www.epa.gov/hudson and in the local repositories established for the site: Edgewater Public Library, 49 Hudson Avenue, Edgewater, NJ 07020; Adriance Memorial Library, 93 Market Street, Poughkeepsie, NY 12601; NY State Library, Cultural Education Center, Empire State Plaza, Albany, NY 12230; Crandall Public Library, 251 Glen Street, Glens Falls, NY 12801; Saratoga County EMC, 50 W. Sauer Dump Added to EPA Superfund List

PHILADELPHIA (March 13, 2012) -- The U.S. Environmental Protection Agency announced today that it added the Sauer Dump in Dundalk, Md. to the Superfund National Priorities List (NPL).

The NPL is a national list of sites where hazardous contaminants could impact public health and/or the environment. NPL sites undergo a thorough investigation to determine the full nature and extent of contamination. EPA or the parties responsible for the contamination then address whatever risks the sites pose to human health and the environment.

The approximately 2.5-acre site, located adjacent to and behind Lynhurst Road, is being added to the NPL because the soil and sediment at the site contain high concentrations of semi-volatile organic compounds, metals, PCBs and pesticides. PCBs and lead are the primary contaminants of concern due to their extreme concentrations.

The partially wooded property is an inactive, privately-owned, unpermitted, former dump. The property was originally a marshland that was filled and stabilized by a past owner. During dump operations from the 1960s through the 1980s, hazardous substances were improperly stored and disposed of on the property.

            The Sauer Dump site is one of nine sites nationwide that EPA is adding to the NPL today. EPA is also proposing 10 other sites to the list today.

EPA Adds Eighteen Mile Creek in Niagara County, N.Y.
to the Superfund List

(New York, N.Y. – March 13, 2012) The U.S. Environmental Protection Agency today announced it has added the Eighteen Mile Creek site in Niagara County, New York to the Superfund National Priorities List of the country’s most hazardous waste sites. Sediment in some areas of the creek is contaminated with harmful chemicals, including polychlorinated biphenyls (PCBs), heavy metals and dioxin, which can have serious effects on people’s health, wildlife and the environment.

“Contamination in the Eighteen Mile Creek is dangerous to the health of people who eat fish from the creek and to the environment,” said Judith A. Enck, EPA Regional Administrator. “Adding the Eighteen Mile Creek site to the Superfund list will allow the EPA to do the extensive sampling needed to find the best ways to address the contamination and protect people’s health.”

The New York State Department of Environmental Conservation, in consultation with EPA, previously investigated four former industrial areas in Lockport, New York, known collectively as the Eighteen Mile Creek Corridor site. The site covers the Flintkote Plant site, United Paperboard Company, Upson Park and the White Transportation property. NYSDEC identified six additional areas within the Eighteen Mile Creek watershed where cleanup activities are also needed. The earlier investigations and sampling of sediment in and around Eighteen Mile Creek confirmed the presence of PCBs, mercury, lead, copper, pesticides and dioxin throughout most of the creek. Specific sources of the contamination have not been definitively identified. EPA’s further investigation into the nature and extent of the contamination in and around Eighteen Mile Creek is expected to begin this summer.

Eighteen Mile Creek flows north for approximately 15 miles and discharges into Lake Ontario at Olcott, New York. The creek has a history of industrial use dating back to the 19th Century when it was used as a source of hydroelectric power. Possible sources of contamination include stormwater discharges and sewage from municipal pipes, pollution from hazardous waste sites or contaminated properties and industrial and municipal waste discharges.

The land within the Eighteen Mile Creek watershed consists primarily of agricultural lands, with residential, commercial and industrial areas located around Lockport, Newfane and Olcott Harbor. There are several wetlands along the contaminated portion of the creek, and people fish in the Eighteen Mile Creek Corridor and other portions of the creek. Fisherman’s Park, a public fishing area located within Eighteen Mile Creek just downstream of Burt Dam, is a major fishing destination.

Nationwide, EPA is proposing to add 10 other sites to the Superfund list today and is designating nine others as final on the list. The EPA periodically proposes sites to the Superfund list and, after responding to public comments, designates them as final Superfund sites. The Superfund final designation makes them eligible for funds to conduct long-term cleanups. The Eighteen Mile Creek site is now designated as final on the Superfund list.

The EPA does an extensive search to identify and locate the parties potentially responsible for the contamination at all sites on the Superfund list. The agency requires responsible parties to pay for or perform the cleanup work with EPA oversight. The majority of Superfund cleanups are performed by or paid for by polluters. Taxpayer dollars are used to cover EPA cleanup costs when no responsible party can be identified.

Metro Container Corp. site added to Superfund list

PHILADELPHIA (March 13, 2012) -- The U.S. Environmental Protection Agency today announced the addition of the Metro Container Corporation site in Trainer, Delaware County, Pa. to the Superfund National Priorities List (NPL).

The NPL is a national list of sites where hazardous substances could impact human health and/or the environment. These sites first undergo a thorough investigation to determine the full nature and extent of contamination. EPA or the parties responsible for the contamination then address whatever risks the sites pose to human health and the environment.

Located about 20 miles south of Philadelphia near the Delaware River, the site has a long industrial history, which includes its use as a chemical manufacturing plant by the Stauffer Chemical Company from 1920 to 1959. The property was also used as a steel drum reconditioning facility by several companies including the Metro Container Corporation, which filed for bankruptcy in 1987. The site is currently owned by Trainer Industries, an industrial painting company that uses the property mainly for storage.

The main source of contamination on the property is a half-acre backfilled industrial waste lagoon that was used for disposal of drum contents and wastewater. The unlined lagoon was eventually filled in with soil and artificial fill materials and is no longer accessible. Additionally, site soils are contaminated. The contaminants of concern at the site are polychlorinated biphenyls (PCBs), inorganics, polyaromatic hydrocarbons (PAHs) and volatile organic compounds (VOCs).

Potential impacts to the surrounding community and environment include contamination to the Delaware River and along the tidal flats of the Delaware River.

The Metro Container site is one of nine sites nationwide that EPA is adding to the NPL today. EPA is also proposing 10 other sites to the list today.

Cleanup Brings Milwaukee Area of Concern Closer to Restoration, Delivers Results Under Great Lakes Initiative
  
CHICAGO (Feb. 17, 2012) - The U.S. Environmental Protection Agency, Wisconsin Department of Natural Resources and Milwaukee County today announced completion of contaminated sediment removal in Lincoln Creek and the Milwaukee River Channel.  This project brings the Milwaukee Estuary closer to being removed from a binational list of Areas of Concern in the Great Lakes.  

"The work by state, county, city and other partners over the years has helped deliver real results under the Great Lakes Restoration Initiative," said Cameron Davis, Senior Advisor to the EPA Administrator.  “Thousands of cubic yards of harmful contaminated sediment were removed to help boost human, ecological and local economic health. But we can’t stop here. We’re looking for new partners to match funds to accelerate cleanups in other Areas of Concern in Wisconsin and around the Great Lakes."

The $24.6 million project under the Great Lakes Restoration Initiative’s Legacy Act removed about 140,000 cubic yards of sediment contaminated with polychlorinated biphenyls and polycyclic aromatic hydrocarbons, or PCBs and PAHs.  The contamination led to limits on eating fish caught in the river, as well as loss of habitat and other environmental problems. 

“The Great Lakes are the largest source of fresh water in the world.  Keeping them clean for the future is a priority,” said WDNR Secretary Cathy Stepp, “We are making major strides cleaning up the Milwaukee River Estuary.  I am pleased that we were able to fund most of the non-federal cost share for this project from state bonding, and delighted at the level of public support this project has received.  With our partners we will continue to work to bring the Milwaukee River back to provide recreational and economic benefits for the Milwaukee area." 

GLRI Legacy Act funds covered about $16 million.  WDNR contributed roughly $8.6 million.  The result was the cleanup of the largest known deposit of PCB-contaminated sediment in this Area of Concern. 

“This joint effort demonstrates the tangible benefits that can come from cooperation between all levels of federal, state and local government. By working together we are removing the impairments to our waterways that resulted from our long industrial history,” said Milwaukee County Executive Chris Abele.  “This significant portion of the Milwaukee River and its natural resources are now cleaner, safer and more sustainable. We embrace the triumphant return of this park land to the greater use and enjoyment of our citizens.”

The Milwaukee River section of the Area of Concern extends from Cedar Creek downstream through the Outer Harbor. It includes Cedar Creek, Lincoln Creek and portions of the Menomonee, Little Menomonee and Kinnickinnic rivers.  In the 1980s, the U.S. and Canada identified 43 highly degraded shoreline areas along the Great Lakes.  Today there are 30 AOCs wholly in the U.S. or shared with Canada.

The Great Lakes provide 30 million Americans with drinking water and underpin a multi-billion dollar economy.  In February 2009, President Obama proposed the GLRI, the largest investment in the Great Lakes in two decades. 




The Action Plan, which covers FY 2010 through 2014, was developed by a task force of 16 federal departments and agencies to implement the president’s historic initiative.  It calls for aggressive efforts to address five urgent priority focus areas:
•Cleaning up toxics and toxic hot spot areas of concern.
•Combating invasive species.
•Promoting near-shore health by protecting watersheds from polluted runoff.
•Restoring wetlands and other habitats.
•Tracking progress, education and working with strategic partners.

The plan also ensures accountability by establishing measures of progress and benchmarks for success.

EPA and TDSHS Warn Against Consumption of Contaminated Fish

(DALLAS – February 2, 2012) During the week of February 6-12, 2012, representatives from the Environmental Protection Agency (EPA) and the Texas Department of State Health Services (TDSHS) will be in the area of South Alamo, Texas, to speak with residents about the contamination in the Donna Reservoir and Canal. This effort is being made to provide local residents with information about the health risks of consuming fish taken from the Donna Reservoir and Canal. The possession of contaminated fish taken from the reservoir is prohibited by the TDSHS.

The principal pollutants in the reservoir are polychlorinated biphenyls (PCBs). PCBs are a group of synthetic organic chemicals that can cause a number of different harmful effects in humans. The primary risk to human health from PCBs is from suspended sediment in the water and the consumption of contaminated fish. Effects of consumption of contaminated fish may include nausea, vomiting, abdominal pain, skin rashes, acne, and cancer. 

The Donna Reservoir and Canal is an EPA Superfund site located in Hidalgo County in southern Texas just north of the Rio Grande. The site includes the Donna Reservoir, the Donna Main Canal, the West and East Main Canals which extend north from the reservoir, and a series of interconnecting canals.
