Pollution in the Home: Kitchens Can Produce Hazardous Levels of indoor Pollutants

Berkeley Lab research on indoor air quality finds previously overlooked dangers.

Scientist Brett Singer is a vegetarian. So why has he been frying up hamburgers? Singer and his team of Lawrence Berkeley National Laboratory (Berkeley Lab) indoor air researchers have found hazardous levels of nitrogen dioxide and carbon monoxide in a surprisingly large portion of California home kitchens. What’s more, their studies have shown that the most common device for mitigating this indoor air problem—range hoods—vary widely in performance.
In a small nondescript building in a parking lot on the Berkeley Lab site, Singer’s group has set up a test kitchen to conduct a battery of cooking trials. By frying up burgers and green beans with a variety of range hoods operating at different settings, the researchers are collecting important data on the impacts to air quality as well as developing a standard test for range hoods that could eventually allow consumers to evaluate and compare their effectiveness.

In a study of southern California homes to be published soon in Environmental Health Perspectives, Singer’s group found that a significant portion of residences exceed outdoor air quality standards for several pollutants on a weekly basis as a result of cooking with gas burners. “If these were conditions that were outdoors the EPA [Environmental Protection Agency] would be cracking down. But since it’s in people’s homes, there’s no regulation requiring anyone to fix it,” Singer said. “Reducing people’s exposure to pollutants from gas stoves should be a public health priority.”
Berkeley Lab’s team of indoor air quality researchers is the oldest and most comprehensive in the country and has contributed to many of the standards and building codes now in place for both homes and industrial buildings, such as schools and offices. In recent years, as more attention has been paid to making buildings more energy efficient—which often means making them “tighter,” or less leaky, to reduce heating and cooling costs—ventilation has become increasingly important.
Dangers of Poor Ventilation
Without appropriate ventilation, indoor air quality can suffer and cause serious health problems. A previous Berkeley Lab study, which Singer co-authored with Berkeley Lab scientist Jennifer Logue, found that the aggregate health consequences of poor indoor air quality—of which cooking is the major but not sole source—are as significant as those from all traffic accidents or infectious diseases in the United States.
In a recent study led by Logue, the team analyzed extensive data from several sources to understand how common it is for California homes to experience indoor air pollution at hazardous levels. They estimated that 60 percent of homes in the state that cook at least once a week with a gas stove can reach pollutant levels that would be illegal if found outdoors. That equates to 12 million Californians routinely exposed to nitrogen dioxide levels that exceed federal outdoor standards, 10 million exposed to formaldehyde exceeding federal standards and 1.7 million exposed to carbon monoxide exceeding ambient air standards in a typical week in winter.

Berkeley Lab’s Tips for Buying and Using Range Hoods

  • Turn on the hood every time you cook, and set the fan to the highest setting that the noise is tolerable.
  • Make sure it vents to the outdoors. If it doesn’t, the hood will simply recirculate air in the kitchen.
  • If your range hood does not extend over the front burners, cooking on the back burners could make the hood up to twice as effective at removing pollutants.
  • If buying a new hood, it should cover your front burners and have a setting that moves at least 200 cubic feet of air per minute.
  • If having a range hood is not possible, opening a window while cooking does help.
These pollutants can come both from the cooking burners—especially gas burners but to a lesser extent electric burners also—as well as from cooking itself. The primary health effect of nitrogen dioxide, which is also found in the fumes of any type of combustion, is an increased likelihood of respiratory problems. Exposure to carbon monoxide is most serious for those who suffer from cardiovascular disease as it can enter the bloodstream and reduce oxygen delivery to the body’s organs and tissues.
The indoor pollutant that scientists believe may be most harmful to human health is particles, including fine particles, which are less than 2.5 micrometers in diameter, and ultrafine particles, which are smaller than 1 micrometer. They are produced by both gas and electric burners and by cooking. They are potentially very harmful because they can enter the lungs and, for the smaller particles, enter the bloodstream or other tissues.
“Electric burners produce ultrafine particles essentially by volatilizing dust,” Singer explained. “It’s the same process with your toaster, resistance heater or radiator if you haven’t used it for awhile. After you turn it on, you can smell it­—it smells terrible. You’re smelling the chemicals that have been volatilized. Once they’re in the air, they recondense into these ultrafine particles. This is the chemistry lab in your kitchen.”
Range Hoods Can Help—Or Can They?
Singer recommends the use of range hoods while cooking. “If every one one of those homes were to use a range hood that exhausts to the outside and is even moderately effective, the number of homes exceeding the standards would drop by more than half,” he said.
Still, Singer’s previous studies have found that range hoods vary widely in their capture efficiency, or effectiveness at removing pollutants. In a laboratory study of seven modelsranging from $40 to $650, he and colleague Woody Delp found capture efficiencies ranging from 15 to 98 percent, and also found that a higher price did not guarantee better performance.
Another study of 15 range hoods installed in homes found that airflows often fell below advertised values and that less than half of the pollutants emitted by gas burners are removed in many instances. What’s worse, there’s no rating system that will tell consumers which products are better at removing pollutants.
A Rating System for Range Hoods
This is where the burgers come in. In the test kitchen Singer and his team are measuring the pollutants emitted by cooking foods at different temperatures and then evaluating how effective different range hoods used in different configurations are in capturing the pollutants.
Delp is in charge of making sure that every burger and every batch of green beans is cooked in precisely the same way each time—whether operating at low or high setting, whether on the front or back burner, repeated three times each. He is also making a “simulated pie,” which consists of a spoonful of corn syrup on a pan to simulate drippings—the main source of emissions from the oven—to gather the same data for baking.
The aim of these experiments is to develop a reliable test methodology that manufacturers of range hoods can use to give a rating to their product. Currently, range hoods are rated only for energy efficiency and noise level but not for pollutant capture efficiency.
“There are some relatively effective and quiet range hoods on the market at affordable prices,” Delp said. “Still, while consumers can get information about sound levels and airflow ratings for some models, there is currently no standard rating for effectiveness. ”
The Berkeley Lab researchers are working toward an ASTM International test standard that manufacturers could voluntarily use to rate their products.
Further down the road, Singer’s team would like to see quieter hoods that come on automatically. The research involves finding a robust control algorithm for turning the fan on and off. “We want systems that don’t require people to turn things on,” Singer said. “When your water heater comes on, the exhaust gases go outside, and you don’t have to flip a switch. It should be the same in the kitchen.”

Sinclair Oil to Pay $3.8 Million Penalty and Install Pollution Controls at Wyoming Refineries to Resolve Violations of 2008 Consent Decree

WASHINGTON – The U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice announced a settlement with two subsidiaries of Sinclair Oil Corporation to resolve alleged violations of air pollution limits established in a 2008 consent decree at refineries in Casper and Sinclair, Wyo. Sinclair Casper Refining Co. and Sinclair Wyoming Refining Co. will pay stipulated penalties totaling $3,844,000 and spend approximately $10.5 million on additional pollution control equipment and other projects to resolve the allegations. The settlement will require the Sinclair companies to reduce emissions of nitrogen oxides (NOx) by approximately 24 tons per year, sulfur dioxide (SO2) by approximately 385 tons per year, and particulate matter by approximately 59 tons per year.

“EPA is committed to ensuring that companies comply with environmental requirements that protect people's health,” said Cynthia Giles, assistant administrator for EPA’s Office of Enforcement and Compliance Assurance. “This settlement holds Sinclair accountable for exceeding the emissions limits agreed to in a previous settlement for Clean Air Act violations and ensures that the people of Wyoming have cleaner, healthier air.”
“Parties who enter into consent decrees with the United States must adhere to their obligations, and failure to comply will result in further penalties,” said Ignacia S. Moreno, assistant attorney general for the Environment and Natural Resources Division of the Department of Justice. “This settlement requires Sinclair to pay a significant $3,844,000 penalty and provide additional emission reductions beyond those required in the original settlement.”

The alleged violations stem from Sinclair’s failure to meet the terms of the 2008 consent decree, including exceeding NOx emissions limits at the Casper and Sinclair, Wyoming refineries and failing to comply with requirements to operate and maintain a flare gas recovery system at the Sinclair Refinery, resulting in excess emissions of SO2. The problems will be addressed by installing and operating a selective catalytic reduction system to control NOx emissions and by upgrading the flare gas recovery system to meet SO2 emissions limits. Sinclair will also complete a project to provide road paving at its Casper refinery that will reduce particulate matter emissions by an additional 59 tons per year
and reduce fuel oil burning at the Casper refinery from the existing 188 tons per year limit to no more than 95 tons per year.

The settlement is subject to a 30-day public comment period and final court approval.

Maine Company Faces Penalty for Violations of Oil Pollution Prevention Regulations

(Boston, Mass. – August 2, 2012) A Maine company that provides motor vehicle services and fuel oil sales is facing a fine of up to $177,500 for violations of the Clean Water Act. 

 EPA recently filed a complaint against the J&S Oil Co., Inc. for failing to maintain and fully implement an oil spill prevention plan, which contributed to the release of approximately 1,500 gallons of used motor oil from a tanker truck at the facility.

The oil release in March 2012 prompted an emergency response from the Maine Department of Environmental Protection and EPA.  The company also hired an oil spill response company to contain the spilled oil and dispose of contaminated soils. 

EPA determined that the company had failed to fully maintain and implement it Spill Prevention, Control and Countermeasure (SPCC) plan, as required by the Clean Water Act. SPCC plans specify spill prevention measures at facilities that store oil above threshold amounts and help ensure that a tank failure or oil spill does not lead to oil reaching bodies of water.  In its complaint EPA alleges that the company failed to provide for adequate secondary containment for some of the facility’s above-ground storage tanks and the tanker trucks parked at the facility; failed to provide secondary containment for the loading/unloading rack; failed to maintain adequate training records of oil-handling personnel in the operation and maintenance of equipment to prevent discharges; and, failed to provide adequate security for the facility.

Shenango, Inc. Settles Air and Water Pollution Violations with EPA, Pennsylvania and Allegheny County

(PHILADELPHIA – July 25, 2012) The U.S. Environmental Protection Agency (EPA), the Pennsylvania Department of Environmental Protection (PADEP) and the Allegheny County Health Department (ACHD) have reached a settlement with Shenango Inc. (Shenango) resolving alleged air and water pollution violations at the company’s coke manufacturing plant on Neville Island, Allegheny County, Pa. The consent decree requires the company to pay $1.75 million in civil penalties and make significant upgrades to the plant, which is located about five miles north of downtown Pittsburgh.
Manufacturing coke involves heating coal at high temperatures in an industrial oven until it forms a residue. This residue, known as coke, is used in steel manufacturing as a fuel in blast furnaces, which are used to refine iron ore into steel. Coke manufacturing also produces gases and particles, some of which are hazardous, that are regulated by the federal Clean Air Act.
The Shenango facility has a history of noncompliance with federal, state and county regulations protecting public health from air pollution. In 2000, the previous owner of the plant entered into a consent decree with EPA and ACHD to bring the facility into compliance.
Since that time, the violations including emissions of sulfur and visible emissions of particulate matter have continued. As part of this settlement, the company must take actions to reduce visible particulate emissions to meet Clean Air Act standards by making repairs to the plant’s coke ovens.
The governments’ complaint also alleges numerous violations of the Clean Water Act including: exceeding the pollutant limits of the facility’s permit for discharging wastewater for several years; failure to properly operate and maintain the facility’s wastewater treatment plant; and unpermitted discharges of polluted runoff from the coal pile directly to the Ohio River.
The part of the consent decree between EPA, PADEP and Shenango resolving Clean Water Act violations requires the company to take remedial actions including:
  • Building a new biological wastewater treatment plant;
  • Implementing immediate upgrades to its current treatment processes while the new treatment facility is being constructed; and
  • Constructing a coal pile runoff management system.
The civil penalties in the proposed consent decree include $1.25 million to be divided equally between the United States and Allegheny County for the facility’s Clean Air Act violations. The company has also agreed to pay Clean Water Act civil penalties of $500,000 divided equally between the United States and Pennsylvania. The consent decree is subject to federal court approval, after a 30 day public comment period.

Designations Complete Most Massachusetts Coastal Water Protections

(Boston, Mass. – July 20, 2012) – In a major milestone completing the protection of more than 95 percent of Massachusetts coastal waters from boat-generated sewage pollution, EPA has designated the coastal waters of Nantucket, Vineyard Sounds and the Islands, and Mt. Hope Bay as “No Discharge Areas.”
With this designation, discharges of treated and untreated boat sewage are prohibited within the town boundaries of Chilmark, West Tisbury, Tisbury, Oak Bluffs, Edgartown, Gosnold, Falmouth, Mashpee, Barnstable, Yarmouth, Dennis, Harwich, Chatham and Nantucket; and within the waters of Mt. Hope Bay.
Furthermore, with these final designations, it means that all the coastal waters of Massachusetts, and all waters between Long Island Sound and the New Hampshire – Maine border benefit from curtailing boat discharges of treated and untreated sewage.
“EPA is thrilled that Massachusetts has achieved this significant milestone in protecting coastal water quality and our local environment. We applaud each and every community, and regional and state officials, all of whom have done the important work to ensure a cleaner and healthier environment providing the foundation for a vibrant economy and healthy communities,” said Curt Spalding, regional administrator of EPA’s New England office. “There are few environments more special than the beaches and bays of Massachusetts, and now our citizens and visitors can rest assured that we are doing everything we can to protect these cherished environments.”
"Our environment and economies depend on safe and productive coastline," said Massachusetts Energy & Environmental Affairs Secretary Richard Sullivan. “With this designation, nearly all of our coastal waters are protected from boat pollution, providing clean resources for tourism and recreational activities like swimming and fishing and habitat for marine life.”
The designation of Nantucket, Vineyard Sounds and the Islands includes 143 bathing beaches, 26 miles of coastline and encompasses approximately 733 square mile of state waters. EPA and the Commonwealth have worked on this designation for more than five years, due to the substantial issues in involved.  All parties sat down and worked through each issue.  Two years ago the “Island Queen” bought a pumpout boat to make sure they would be in compliance.  The Steamship Authority worked out a schedule for retrofitting their vessels and installing the pumpout facilities for their vessels.
The designation for Mt. Hope Bay means that discharging boat sewage is prohibited within the town boundaries of Dighton, Berkley, Freetown, Somerset, Swansea, and Fall River.  Mount Hope Bay is a shared waterbody between Mass. and R.I. and in 1998 Rhode Island designated all their state waters as no discharge, including Mount Hope Bay.
Many other areas in New England already have designated their coastal waters as No Discharge Areas these include:
•         All state marine waters of Connecticut, Rhode Island, and New Hampshire; and now nearly all in Massachusetts;
•         In Maine, Boothbay Harbor, Casco Bay, Kennebunk/Kennebunkport/Wells, Southern Mount Desert area and West Penobscot Bay (Camden/Rockport/Rockland);

EPA to Review Technical Information on Mercury and Air Toxics Standards for New Power Plants

Routine review has no impact on cost or vital health benefits of first national standards for mercury pollution

WASHINGTON – The U.S. Environmental Protection Agency (EPA) is reviewing technical information that is focused on pollution limits for new power plants under the Mercury and Air Toxics Standards, based on new information provided by industry stakeholders after the rule was finalized.
This review, which is not an uncommon step for major standards, will have no impact on the sensible, achievable, and cost-effective standards already set for existing power plants, which will protect millions of families and, especially, children from air pollution. By moving quickly to review the new information, this action will provide greater certainty for five planned future facilities, in Georgia, Kansas, Texas, and Utah, that would be covered by the standards. This review will not change the expected costs or public health benefits of the rule.

EPA’s Mercury and Air Toxics Standards, which take advantage of existing flexibilities, are the first national standards to protect American families from power plant emissions of mercury and toxic air pollution like arsenic, acid gas, nickel, selenium, and cyanide. By ensuring that existing power plants install widely available pollution control equipment, the standards will prevent as many as 11,000 premature deaths and 4,700 heart attacks a year. The standards will also help America’s children grow up healthier-- preventing 130,000 cases of childhood asthma symptoms and about 6,300 fewer cases of acute bronchitis among children each year.

EPA will review monitoring issues related to the mercury standards for new power plants and will address other technical issues on the acid gas and particle pollution standards for these plants. The agency’s review will not change the types of state-of-the-art pollution controls new power plants are expected to use to reduce this harmful pollution.

This type of review, known as a “reconsideration,” is a routine tool that EPA often uses to ensure that its standards incorporate all relevant information, in cases where information only becomes available after a rule is promulgated. The agency’s decision to reconsider the standards for new sources reflects its ongoing commitment to work with industry and other stakeholders to ensure that all of EPA’s standards protect public health while being achievable and cost-effective. The agency will follow an expedited, open and transparent process that includes public comment on any proposed changes. The agency will complete the rulemaking by March 2013 and will also use its Clean Air Act authority to stay the final standards for new power plants for three months during this review.

(New York, N.Y. – July 19, 2012) The U.S. Environmental Protection Agency today announced that the Cooper’s Ferry Partnership in Camden, New Jersey has been selected to receive $70,000 worth of technical assistance to advance projects aimed at reducing water pollution in Camden. The EPA will provide the assistance to help estimate the benefits of the Camden SMART (Stormwater Management And Resource Training) Initiative. The SMART Initiative is a joint project by the city of Camden, the Cooper’s Ferry Partnership, the Camden County Municipal Utilities Authority and other community partners to develop a network of green infrastructure programs and projects throughout the city. Green infrastructure captures and filters pollutants by passing stormwater through soils and retaining it on site. Camden is one of just 17 communities receiving such assistance from the EPA this year.

“Camden’s SMART Initiative is a smart way to fight water pollution and make the local economy stronger,” said EPA Regional Administrator Judith A. Enck. “By working together, we can make our urban communities cleaner and more livable. I commend the Cooper’s Ferry Partnership and this initiative’s other partners for leading the way to a sustainable and revitalized Camden.”

Controlling stormwater is one of the most widespread challenges faced by communities across the country. Large volumes of polluted stormwater degrade our nation’s rivers, lakes, and aquatic habitats and contribute to downstream flooding. Communities are increasingly using green infrastructure to supplement or substitute for single-purpose “gray” infrastructure investments such as pipes, filters, and ponds. Effective green infrastructure tools and techniques include green roofs, alternative designs for streets and buildings, trees, rain gardens, and rain harvesting systems.

The SMART Initiative is an effort to restore and revitalize Camden through efficient stormwater management. In less than one year, Camden has planted eleven rain gardens and has developed plans for 20-40 more. Camden SMART has organized and hosted a series of stormwater management education and information sessions with residents and produced literature on sound stormwater management practices. Additionally, the initiative has supported the removal of impervious surfaces such as blacktop to plant hundreds of street trees throughout Camden.

Under the partnership announced today, the EPA will help complete an assessment of the water quality, air quality, and brownfield remediation benefits, and the flooding mitigation potential of the SMART Initiative. The EPA will additionally help Camden SMART conduct an assessment of the barriers posed by local codes and permitting processes for various green infrastructure projects. The EPA will also help Camden identify appropriate green infrastructure practices for brownfield sites and other sites that pose potential challenges for the implementation of green infrastructure.

Sampling data will determine whether water quality standards are being met, note any changes in the quality or condition of the tribe’s water and provide planning tools to improve the function and health of stream ecosystems.

The mission of the EPA is to protect public health and the environment. The EPA supports our nations’ tribes in all aspects of the work needed to improve the water quality of tribal land watersheds. This cooperative spirit supports work to protect water quality that ensures the health of watersheds that cross state and tribal boundaries.

The funds will be used by NMED to administer the state’s Air Pollution Prevention and Abatement Program which aims to prevent, reduce and eliminate air pollution. The funds will also be used to administer the State’s air permitting, air planning, environmental compliance programs and ambient air monitoring activities.

The NMED will monitor for major pollutants, identifying major and minor sources of air pollution that may be impacting New Mexico. This will assist in helping New Mexico residents live healthier lives and breathe more easily.

(Kansas City, Kan., July 9, 2012) - EPA Region 7’s Office of Tribal Affairs has awarded two grants to the Prairie Band Potawatomi Nation to support water pollution control efforts and provide general assistance to the tribe’s environmental protection programs.

The Prairie Band Potawatomi Nation, headquartered near Mayetta, Kan., occupies approximately 77,400 acres of reservation land in Jackson County in north central Kansas. The tribe has more than 4,700 members, more than 700 of whom reside on the reservation.

A $12,173 grant will allow the tribe to continue to build capacity for comprehensive planning and environmental protection programs to protect the quality of the environment within the reservation. Funding will administer an environmental office, develop water programs to reduce pollution sources, build capacity for solid waste management, and assist with community outreach and environmental education.

A $3,500 grant will allow the tribe to continue to conduct surface and groundwater monitoring on the reservation to determine whether the water is impaired or unsafe for human contact. The grant will also fund a quality assurance project plan and assessment report; revisions to the monitoring strategy as needed; water quality training; and outreach activities to provide tribal members with information about water quality.

EPA provides financial assistance to states and tribes to help them implement environmental programs. States and tribes may receive these funds in individual environmental program categorical grants, or choose to combine grants in a performance partnership grant.

The Prairie Band Potawatomi Nation is one of nine federally recognized tribes within EPA Region 7.

Ralcorp Commercial Bakery in Lodi to Pay More than $1.3 Million for Air Violations

U.S. EPA, San Joaquin Valley Air District assess penalty
SAN FRANCISCO – The U.S. Environmental Protection Agency and the San Joaquin Valley Air Pollution Control District today announced a Clean Air Act settlement with Ralcorp’s Cottage Bakery in Lodi, Calif. after the facility failed to obtain permits and install proper air pollution controls. The company will pay a penalty of $625,000.
In addition, the company paid $750,000 to install and operate a thermal oxidizer that reduces volatile organic compound (VOC) emissions by 95 percent. VOC emissions are considered a precursor to ozone and particulate pollution. San Joaquin Valley violates the federal air quality standard for both ozone and particulate pollution and has some of the poorest air quality in the nation.
“Air quality is a critical human health issue in the San Joaquin Valley,” said Jared Blumenfeld, EPA’s Regional Administrator for the Pacific Southwest. “Our enforcement action requires air pollution controls at the plant to protect the communities in the Valley from illegal emissions.”
The EPA’s investigation of the facility included an inspection conducted on July 27, 2009. The EPA’s investigation revealed that the facility had never applied for air pollution permits to install and operate the facility’s ovens and associated air pollution controls. Ethanol, a VOC, is generated during the leavening stage of bread manufacturing and is later released during baking. Cottage Bakery’s production facility includes three bread ovens installed at various times between 1997 and 2006.
Cottage Bakery is a large-scale commercial bakery with about 625 employees. The facility produces frozen bread and cake products that are used by retail bakeries and the food service industry throughout the U.S. and Canada. Cottage Bakery, Inc. is owned by Ralcorp Frozen Bakery Products, headquartered in Downers Grove, Ill.
The proposed consent decree for the settlement, lodged with the U.S. District Court for the Eastern District of California on June 26, 2012, is subject to a 30-day comment period and final court approval. EPA Guides Marinas on Best Ways to Prevent Water Pollution

(New York, N.Y. – May 24, 2012) With Memorial Day and summer approaching, the U.S. Environmental Protection Agency is recommending that New York State marinas take steps to prevent the pollution of local waterways. At the Albany Yacht Club this morning, EPA Regional Administrator Judith A. Enck highlighted the best environmental practices for reducing pollution from boat washing and other maintenance activities that can degrade water quality. These practices are captured in an easy-to-read manual created by the EPA with assistance from the New York State Department of Environmental Conservation. It has been provided to over 500 marina operators throughout New York State and provides recommendations on ways marina owners and operators can reduce pollution through more efficient use of materials, energy and land.

“Marina operators play important roles in protecting the health of our coastal waters and beaches," said EPA Regional Administrator Judith A. Enck. "The products used in boat maintenance often contain chemicals that can cause serious damage to the marine environment. The EPA is working with the marina industry to ensure that marina operators are aware of the best practices for reducing pollution and make every effort to prevent pollution from occurring.”

Cleaning products and toxic chemicals used in boat maintenance can pollute waterways when they are washed into the water when it rains. The effect of runoff from a single boat or marina on a water body may seem insignificant, but when multiplied, it can degrade water quality. Because marinas are located at the water’s edge, the water is affected by maintenance practices and pollution that flows into the water from surrounding areas.

Earlier this year, the EPA entered into legal agreements with three Westchester County marinas for violations of the federal Clean Water Act. The marinas had each failed to renew their stormwater permits and failed to conduct annual monitoring associated with stormwater discharges, which is required under the permits. The Huguenot Yacht Club of New Rochelle, the Beach Point Club of Mamaroneck and the American Yacht Club of Rye each agreed to pay penalties ranging from $8,500 to $9,900 to settle these violations.

Key recommendations for preventing water pollution from boat operations and maintenance:
  • Regularly inspect above-ground fuel storage tanks and associated piping for leaks, and ensure that these tanks have secondary containment areas to certain spills.
  • Store spill containment and control materials in a clearly marked and easily accessible location attached or adjacent to the fuel dock.  Keep oil absorbent pads and pillows available at the fuel dock for staff and customers to mop up drips and small spills.
  • Avoid underwater boat bottom cleaning or hull scraping to remove antifouling paint from boat hulls.
  • Make every attempt to collect wash water, treat it and either dispose of it at a sewage treatment plant or recycle it.
  • Perform as much boat repair and maintenance as practicable inside work buildings.  Where an inside workspace is not available, perform abrasive blasting and sanding with spray booths or tarp enclosures.
  • Use cleaning products that are less toxic and contain lower concentrations of volatile organic compounds, ozone depleting chemicals and toxic materials.  Always clean with water and a coarse cloth first.
  • Permanently seal floor drains in maintenance areas with concrete if they do not connect to a sewer or holding tank.  Sweep or vacuum floors often and immediately before floor washing.
  • Use propylene glycol antifreeze (usually pink), which is less toxic than ethylene glycol (usually green) to winterize all systems except "closed" or freshwater cooling systems.
  • Minimize impervious areas on the marina site by paving only where absolutely necessary.  Plant a vegetated filter strip or buffer between impervious areas and the marina basin.

Settlement to improve air quality and establish a trust to fund environmental projects on the Uintah and Ouray Reservation in Northeastern Utah

WASHINGTON – The U.S. Environmental Protection Agency (EPA) and the U.S. Department of Justice announced a settlement with QEP Field Services Co. (QEPFS), formerly Questar Gas Management Co., to resolve alleged violations of the Clean Air Act at five natural gas compressor stations on the Uintah and Ouray Reservation in Northeastern Utah. Four members of the Ute Indian Tribe intervened as co-plaintiffs. Under the proposed settlement, QEPFS will pay a $3.65 million civil penalty and pay $350,000 into a Clean Air Trust Fund to be established by the tribal member intervenors. The settlement also requires QEPFS to reduce its emissions by removing certain equipment, installing additional pollution controls, and replacing the natural gas powered instrument control systems with compressed air control systems.

“Natural gas extraction projects help to fuel our economy, but also need to follow the nation’s laws,” said Cynthia Giles, assistant administrator of EPA’s Office of Enforcement and Compliance Assurance. “Today’s settlement will bring cleaner air to the members of the Northern Ute Tribe by ensuring natural gas compressor stations are operated in compliance with the law and by creating a trust to fund environmental projects on the Uintah and Ouray Reservation.”

“This settlement will result in cleaner air for residents living on the Uintah and Ouray reservation and allow the responsible development of energy resources in accordance with the Clean Air Act,” said Ignacia S. Moreno, assistant attorney general for the Environment and Natural Resources Division of the Department of Justice. “It also will establish the Tribal Clean Air Trust Fund to fund environmental projects for the benefit of tribal members.”

QEPFS’s compressor stations remove water and compress natural gas for transportation through gas pipelines. They are sources of air pollution, emitting hazardous air pollutants (HAPs), volatile organic compounds (VOCs), and nitrogen oxides (NOx), which can increase the risk of asthma attacks and are significant contributors to the formation of ozone. The actions required in the settlement will eliminate approximately 210 tons of NOx, 219 tons of carbon monoxide, 17 tons of HAPs, and more than 166 tons of VOCs per year. It will also conserve 3.5 million cubic feet of gas each year, which could heat approximately 50 U.S. households. The reduction in methane emissions (a greenhouse gas that is a component of natural gas) is equivalent to planting more than 300 acres of trees.

QEPFS is a wholly-owned subsidiary of QEP Resources, Inc., which is headquartered in Denver.QEPFS provides midstream field services such as natural gas gathering, compression, dehydration and processing to upstream natural gas companies.

The consent decree is subject to a 30-day public comment period and final court approval.

Southern Cape Cod, Martha’s Vineyard and Nantucket Seek to Protect Coastal Water from Boat Pollution

(Boston, Mass. – May 4, 2012) – EPA is considering a proposal to designate the coastal waters of Nantucket and Vineyard Sounds and the Islands as a “No Discharge Area.” If approved, discharges of treated and untreated boat sewage would be prohibited within the town boundaries of Chilmark, West Tisbury, Tisbury, Oak Bluffs, Edgartown, Gosnold, Falmouth, Mashpee, Barnstable, Yarmouth, Dennis, Harwich, Chatham and Nantucket.
On behalf of the Commonwealth, the Massachusetts Coastal Zone Management (MA CZM) has petitioned EPA to approve the No Discharge designation, with the towns’ concurrence. EPA has in turn published the request in the Federal Register and will accept public comments on the proposal for 30 days, ending May 29, 2012.

“Protecting coastal water quality and our local environment is just good common sense.  This step helps protect the foundation of a vibrant local economy and healthy communities,” said Curt Spalding, regional administrator of EPA’s New England office. “Especially in these areas where visitors spend their time and vacation budgets, and where active shellfisheries bolster local incomes, EPA applauds these communities for taking an important step to protect the environment.”

This proposed designation includes 143 bathing beaches, 26 miles of coastline and encompasses approximately 733 square mile of state waters. Along with a similar proposal to designate Mt. Hope Bay as a no discharge area, if approved these two areas will mean that all coastal waters in Massachusetts are protected from treated and untreated boat sewage.

Before EPA will endorse a No Discharge Area designation for any area, the applicant must demonstrate that there are enough “pumpout” facilities where boaters can get their sewage holding tanks pumped out. This particular area has an estimated 15,283 boats, of which 5, 075 may have a head or toilet on board.  Massachusetts has certified that there are 29 pumpout facilities within the proposed area available to the boating public. 
This designation has been under development for more than 5 years, due to the substantial issues in involved.  All parties sat down and worked through each issue.  Two years ago the “Island Queen” bought a pumpout boat to make sure they would be in compliance.  The Steamship Authority worked out a schedule for retrofitting their vessels and installing the pumpout facilities for their vessels. 


Many other areas in New England already have designated their coastal waters as No Discharge Areas, including:

•         All state marine waters of Connecticut, Rhode Island, and New Hampshire. If the two currently pending requests are approved, all of Massachusetts coastal waters will be protected as well;
•         In Maine, Boothbay Harbor, Casco Bay, Kennebunk/Kennebunkport/Wells, Southern Mount Desert area and West Penobscot Bay (Camden/Rockport/Rockland).
