(New York, N.Y. – August 23, 2013) The U.S. Environmental Protection Agency has proposed a plan to address contaminated soil at the Maywood Chemical Company Superfund site in Maywood and Rochelle Park, New Jersey. Previous industrial activity at the site resulted in contamination of the soil and ground water with volatile organic compounds, radioactive waste and metals. Exposure to these pollutants can have serious health effects, and in some cases, increase the risk of cancer. The EPA proposal calls for a combination of removing and treating contaminated soil.

"The cleanup plan proposed by EPA will address the contaminated soil and reduce the risk posed by the contamination to people’s health and the environment,” said EPA Regional Administrator Judith A. Enck. “The EPA encourages the public to attend the Maywood Chemical Company Superfund site meeting and share their views on the proposed plan.”

The EPA will hold a public meeting on September 9, 2013, to explain the proposed plan and is encouraging public comments. The meeting will be held at the Maywood Public Library, Trinka Hall (lower level) at 459 Maywood Avenue, Maywood, New Jersey, from 7:00-9:00pm. Comments will be accepted until September 23, 2013.

Operations at the former Maywood Chemical Works began in 1895 and from 1916 to 1955 included thorium processing, which produced radioactive waste. Other manufacturing activities generated various types of chemical and radiological wastes. These waste materials were used as fill on the former Maywood Chemical Works property and at nearby properties. The site is being addressed jointly by the U.S. Army Corps of Engineers and Stepan Company, which currently owns and operates a manufacturing facility at the site. The EPA is overseeing the work.

Because of the nature and complexity of the contamination at the site, the cleanup work was divided into several phases. Under previous cleanup plans, the Army Corps of Engineers is working to address radioactive contamination on more than 88 parcels and radioactive and chemical contamination on an 11-acre government-owned parcel at the site. To date, more than 575,000 cubic yards of radioactively-contaminated material has been removed from the site, significantly reducing the potential for exposure to contamination. Over 60 residential properties, 20 commercial properties, three parks and a local fire station have been cleaned up. Radiological soil cleanup work is ongoing at several commercial properties. The Army Corps is currently designing the groundwater remedy for contaminated groundwater associated with the government-owned property.

Stepan Company is responsible for non-radioactive chemical contamination in soil and groundwater on the former Maywood Chemical Works properties. The EPA’s plan announced today addresses soil that is believed to be a source of ground water contamination for which Stepan Company is responsible.

Under the EPA’s proposed plan, contaminated soil will be dug up and disposed of at facilities licensed to receive the waste. Buried containers will be removed. Excavated areas will then be filled with clean soil and restored. In one of the contaminated areas, the EPA proposed plan calls for removal of harmful chemicals from the soil by extracting them in vapor form with a vacuum and then filtering the vapors through carbon filters to remove contaminants. The EPA will first oversee a study to confirm that this treatment is effective. The proposed plan also calls for two small areas of wetlands with a total area of one and a half acres to be drained to remove the contaminated soil. The water will be pumped from the sediment and treated before being discharged. The wetland areas will be restored with vegetation and soil having properties similar to the existing wetlands.

In some areas where contamination remains in place, the EPA plan will prohibit activities that could disturb the site and allow potential exposure to the contamination in the future. The EPA is also requiring periodic review and evaluation of the work to verify that the actions taken continue to protect people’s health and the environment.

The Superfund program operates on the principle that polluters should pay for the cleanups, rather than passing the costs to taxpayers. After sites are placed on the Superfund list of the most contaminated waste sites, the EPA searches for parties responsible for the contamination and holds them accountable for the costs of investigations and cleanups. In this instance, the site is partially being addressed by the federal government under a program to cleanup radioactive contamination at sites across the country, called Formerly Utilized Sites Remedial Action Program (FUSRAP). A portion of the site, which is the subject of today’s proposed plan, is being addressed by the Stepan Company.

Hazardous Waste Settlement Leads to School Cleanups in 60 Schools in R.I. and Mass.
(Boston, Mass. – August 23, 2013) – A commercial waste handler in Rhode Island has agreed to pay a fine of $58,278 and to spend $252,152 to clean hazardous chemicals out of approximately 60 schools in Rhode Island and Massachusetts in order to settle EPA claims that the company violated state and federal hazardous waste laws at a facility in Providence, R.I.
Northland Environmental and its owner, PSC Environmental Services, will remove chemicals from 60 high schools and middle schools within a 50-mile radius of their Providence facility at 275 Allens Ave. where the violations occurred. The companies have agreed to pack up and properly dispose of both hazardous and non-hazardous wastes stored at the schools; to do hazardous waste training for science and art teachers; and to purchase safety equipment such as storage cabinets for flammable chemicals, eye washes and deluge showers for classrooms where hazardous chemicals are used. This project will be done over 18 months during times when the schools are closed.
EPA alleged that Northland/PSC Environmental Services violated the federal Resource Conservation and Recovery Act (RCRA) and state hazardous waste laws by failing to properly identify certain hazardous wastes and failing to properly maintain hazardous waste tanks and containers. These alleged violations could have resulted in the release of hazardous wastes to the environment. The company also stored incompatible hazardous wastes next to one another, creating a potential for fire or explosions. The company quickly came into compliance after the violations were identified.
“All facilities that generate or manage hazardous wastes have an obligation to make sure they carefully adhere to the environmental requirements that result in safer, cleaner communities,” said Curt Spalding, regional administrator of EPA’s New England office. “This case will have a positive outcome, since the projects under this settlement will help provide safer classrooms at many schools in Rhode Island and Massachusetts.”
The school clean outs will involve removing outdated and unwanted chemicals from schools at no cost to the participating schools. Chemical management is often a low priority for schools and it is not uncommon for school science departments to have outdated and unneeded stock chemicals present.
“I want to thank the EPA and the Cranston School Department for working cooperatively to provide a safe environment for our students,” said City of Cranston Mayor Allan Fung.
“We are pleased to see funds from EPA actions like this reinvested in making Rhode Island a cleaner and safer place,” said Terrence Gray, P.E., Associate Director for Air, Waste and Compliance at the RI Department of Environmental Management.  “For many years, DEM has directly supported school districts across Rhode Island by removing old and unnecessary chemicals, but that effort has always been limited by the resources we have available. This recent investment extends this important initiative so that more of these dangerous materials can be taken out of our schools, providing a much safer environment for students and educators.”
“The science classroom environment is of the utmost importance as we work to support teaching and learning for students and teachers. Safety is our first concern so we were delighted to have a partnership with the EPA Integrated Chemical Management Program (ICM) who worked with our science teachers to inventory, organize chemicals, with regards to safety and to the benefit of classroom use. Working with this program provided our teachers with invaluable insights with regards to managing chemical supplies. The ultimate goal is to maximize safety and learning of science inquiry in Cranston Public Schools,” said Dr. Judith Lundsten, Superintendant Cranston Public Schools.
Rhode Island schools within a 50-mile radius of the Northland facility were sent emails letting them know of this opportunity to have toxic, hazardous, or chemicals prohibited by the state removed by participating in this project. Schools that were interested provided a list of the chemicals that need to be removed. Cranston, R.I. is using the opportunity to provide both East and West High School with chemical cleanouts before school starts on Aug. 27. 
In addition to paying the fine and completing the environmental project, Northland/PSC has agreed to make sure the Providence facility remains in compliance with federal and state hazardous waste management regulations.
Northland/PSC’s Providence facility accepts and handles a broad spectrum of wastes including acids, alkalis, flammable wastes, water reactive wastes, cyanides, sulfides, oxidizers, toxic wastes, oily wastes, photochemical wastes and laboratory packs. Hazardous and non-hazardous wastes are received, stored and or consolidated and then shipped off site for treatment or disposal.

WHAT: U.S. Environmental Protection Agency Administrator Gina McCarthy will travel to Alaska next week to highlight the President’s commitment to addressing climate change and its impact on the state. Administrator McCarthy plans to visit the Portage Glacier near Anchorage to survey the effects of climate change on the region. McCarthy is also scheduled to visit the Bristol Bay watershed where she will meet with tribes, industry representatives, fishermen, and other stakeholders in the area. McCarthy will also visit Fairbanks to discuss ongoing air quality issues facing the community. More details are being finalized and will be released shortly.

U.S. EPA Announces Brownfield Grants for Genesee County and Mott Community College in Flint

Flint, Michigan (August 22, 2013) -- The U.S. Environmental Protection Agency announced two new brownfield grants totaling $545,000 at an event today at Chevy in the Hole, a site in Flint, Michigan. EPA Region 5 Administrator Susan Hedman, U.S. Rep. Dan Kildee and Mayor Dayne Walling were joined by representatives of Genesee County which received a $350,000 grant to replenish a brownfield revolving loan fund and Mott Community College which received a $195,050 grant to establish a new job training program.

"The grants that EPA is announcing today will be used to clean up contaminated sites in Genesee County and to train 60 people to work in environmental fields," Hedman said. "These grants will fund work that is good for the environment, good for the economy and good for Flint."

Several local companies have agreed to provide graduates of the Mott Community Colleges environmental training program with internships, on-the-job training and employment opportunities.

“Flint will greatly benefit from these two new federal brownfield grants, which will help to retrain workers and retool industrial properties like Chevy in the Hole to productive use,” Congressman Dan Kildee said. “Investing over a half million dollars in local job training programs and environmental cleanup efforts will help to strengthen our local economy and reposition mid-Michigan to compete for new investments and good-paying jobs,” said Congressman Dan Kildee, Michigan 5th Congressional District.

“The environmental cleanup and redevelopment at Chevy in the Hole is the result of years of determined effort. This project shows the success possible when community initiative is combined with the creative use of federal resources,” said Flint Mayor Dayne Walling.

"Mott Community College is excited to be a recipient of the EPA Environmental Workforce Development and Job Training grant. This investment will allow us to leverage other EPA investments in our community designed to revitalize key areas in the city of Flint while providing employment and career pathway opportunities for local residents,” said Robert Matthews, Executive Dean of Workforce and Career Development at Mott Community College.

Since 2004, EPA has provided $3.4 million for brownfield assessments and cleanups in Flint and Genesee County. EPA, the city, the county and Kettering University continue to work together to redevelop the Chevy in the Hole site.

EPA Proposes to Renew Clean Harbors PCB Permit; Public Comment Period Begins

LOS ANGELES – Today the U.S. Environmental Protection Agency is requesting comments on its proposed PCB permit renewal for Clean Harbors Los Angeles, LLC., a commercial hazardous waste treatment, storage, and transfer facility located approximately two miles south of Downtown Los Angeles in the industrial city of Vernon, Calif.  

EPA’s proposed permit, if finalized, would be valid for 10 years and will allow Clean Harbors to continue to receive, store, and repackage PCB wastes. The draft permit imposes new additional safety requirements on the facility including regular random sampling, and more stringent cleanup standards if the facility were to close.

The 45-day comment period begins August 22 and ends October 7, 2013. The EPA is hosting an informational Public Meeting and Hearing on Tuesday, September 24, 2013 from 6 – 8pm at the Slauson Multipurpose Center located at 5306 S. Compton Ave, Los Angeles, CA 90011. Comments on the proposed renewal approval may be submitted over the phone; in writing via mail, email or fax; or in person at the public meeting and hearing. EPA will make a final decision on the renewal of the Clean Harbors PCB Approval after considering all public comments submitted.

The Clean Harbors facility has been in operation since 1980 and has been permitted to store PCBs since 1992.

Products that may contain PCBs include: electrical transformers and capacitors, other electrical equipment, and fluorescent light ballasts. EPA regulates the treatment, storage and disposal of PCBs under the Toxic Substances Control Act.
