EPA to Remove Mercury from Bottom of

(New York, N.Y. – December 19, 2012) The U.S. Environmental Protection Agency today announced its plan to remove mercury contamination from the sediment of the Acid Brook Delta of Pompton Lake in Pompton Lakes, New Jersey to levels that meet stringent standards to protect people’s health and the environment. The plan will go into effect as a modification of a permit, which legally requires the E.I. du Pont de Nemours & Company, Inc. to fund and perform the work. Under the permit modification, the EPA will require DuPont to dredge at least 100,000 cubic yards of mercury contaminated sediment from the bottom of a 40-acre area of Pompton Lake and remove at least 7,800 cubic yards of contaminated soil from a shoreline area of the lake affected by DuPont’s past discharges. All of the sediment and soil will be sent to a licensed disposal facility.

Mercury in the sediment and soil can build up in the tissue of fish and other wildlife and pose a threat to people who eat them. Exposure to mercury can damage people’s nervous systems and harm the brain, heart, kidneys, lungs and immune systems.

“The removal of mercury-contaminated sediment from Pompton Lake is a major step toward the recovery of the lake and the protection of people’s health,” said EPA Regional Administrator Judith A. Enck. “The expanded dredging and other revisions in the final cleanup plan reflect the EPA’s commitment to protecting public health and improving environmental quality in Pompton Lakes.”

In November 2011, the EPA proposed a preliminary permit modification to remove contaminated sediment from the bottom of Pompton Lake and encouraged the public to comment on it. A public hearing on the proposed permit modification was held in January 2012. The final permit modification announced today incorporates changes that were made in response to comments from the public and the U.S. Fish and Wildlife Service and additional technical information received from DuPont after the proposed permit modification was issued. A public meeting to discuss the permit modification for the Acid Brook Delta of Pompton Lakes will be held on January 15, 2013.

Under the final permit modification, the area of sediment that will be removed has been expanded by approximately 35% and sediment sampling is required to identify additional areas of the lake that may require the removal of mercury-contaminated sediment. In addition, DuPont is required to implement long-term monitoring of the effectiveness of the dredging, restore the soil between Lakeside Avenue and the edge of the lake, and perform an ecological risk assessment to determine whether additional action may be needed in the future. DuPont will be required to develop work plans for these requirements, which must be submitted to the EPA for approval. The cleanup will be financed and conducted by DuPont with EPA oversight.

The E.I. du Pont de Nemours & Company, Inc. operated the Pompton Lakes Works facility, located at 2000 Cannonball Road, from 1902 to April 1994. Products manufactured at the facility included explosive powder containing mercury and lead, detonating fuses, electric blasting caps, metal wires and aluminum and copper shells. The manufacturing operations and waste management practices contaminated soil, sediment and ground water both on and off-site. Lead and mercury from its operations were released into Acid Brook, which flows through the eastern part of the facility and discharges into the Acid Brook Delta of Pompton Lake. DuPont’s operations also contaminated the ground water with chlorinated volatile organic compounds, such as tetrachloroethylene, trichloroethylene, cis 1,2-dichloroethylene and vinyl chloride.

The cleanup of the Acid Brook Delta requires a modification of the permit under the federal Resource Conservation and Recovery Act. The final permit modification will become effective on February 4, 2013 pending any requests for appeal submitted prior to that date.

Plans to clean up the remaining areas of contamination will be proposed through future permit modifications after ongoing investigations by DuPont have been completed and reviewed by the EPA and the New Jersey Department of Environmental Protection. Opportunities for public participation will continue to be provided through regular updates, public notices and public meetings.

EPA Study Reveals Shift in Housing Developments Across the U.S. 
More communities embrace redevelopment
WASHINGTON – The U.S. Environmental Protection Agency (EPA) released a new report examining residential construction trends in America’s metropolitan regions, which finds that nearly three out of four large metropolitan regions saw an increased share of new housing development in previously developed areas during 2005 - 2009 compared to 2000 - 2004.  
Known as infill housing, this type of development provides economic and public health benefits to metropolitan areas while protecting the local environment. Infill housing saves money and energy by taking advantage of previous investments in existing infrastructure (such as water, sewer, and roads). This type of development can also help preserve open space, protect natural resources, and reduce transportation emissions and the amount of polluted stormwater washing off new roadways and other paved surfaces. 
 Infill housing has also been shown to help raise property values, increase a community’s tax base, and attract retail businesses to serve the larger residential population.
This report examines data on the location of new home development in metropolitan regions, as well as data on pre-existing land cover.  The report also includes a listing of resources available to local, regional, and state leaders who wish to coordinate land use, housing, and transportation policies.  
The findings of the report demonstrate that infill has become a significant portion of the U.S. housing market.  Among all 209 metropolitan regions examined, 21 percent of new homes were infill, while the remaining share was built on undeveloped land outside existing communities.  Seventy-one percent of large metropolitan regions saw an increased share of infill housing development.  Among 51 large metropolitan regions examined in this study, 36 saw an increased share of infill housing development during 2005-2009 compared to 2000-2004. For example, eight out of ten new homes in San Jose, Calif. were infill. New York, Los Angeles, and San Francisco all saw a majority of new home construction in previously developed areas during the same time period. 
EPA published the first and second editions of Residential Construction Trends in America's Metropolitan Regions in 2009 and 2010. This 2012 report builds on previous work with the HUD-DOT-EPA Partnership for Sustainable Communities to measure metropolitan development trends.

EPA grant to Baltimore City Health Department supports education programs to reduce indoor air pollution

PHILADELPHIA (December 19, 2012) – The U.S. Environmental Protection Agency has awarded a $120,000 grant to the Baltimore City Health Department to support indoor air quality projects including a program to educate about 460 nursing students from the University of Maryland about environmental asthma management.

The funding will also support a training workshop for about 32 medical professionals on how to work with families in neighborhoods where there is a high risk for indoor air pollution issues.

“Reducing the environmental health risks of indoor air contaminants such as asthma triggers can benefit people’s health,” said EPA Regional Administrator Shawn M. Garvin. “This funding supports efforts to improve indoor air quality, which will better protect the health of children and families in the Baltimore area.”

Indoor air pollutants in homes, buildings, and schools can negatively impact the health of occupants. Some pollutants cause health problems such as eye irritation, burning in the nose and throat, headaches or fatigue. Others can worsen allergies, respiratory illnesses (such as asthma) or even cause cancer (from radon gas). Exposure to unhealthy indoor air pollutants in homes, buildings, and schools can be reduced through better design, construction, operational and maintenance practices; personal choices; and mitigation of indoor air quality problems.

The grant to the Baltimore City Health Department is one of 32 EPA grants nationwide to improve indoor air quality, better protecting the health of Americans in classrooms, communities and homes across the country.

EPA Proposes Approval of Arkansas GHG Program

(DALLAS – December 18, 2012) The U.S. Environmental Agency has proposed to approve the State of Arkansas’ program for permitting new facilities that will emit significant amounts of greenhouse gases (GHGs). If approved, the state’s program will replace a federal plan that had been in place since
January 2011.

Final approval would provide the State of Arkansas with authority to issue GHG permits and establish appropriate emissions levels for new or heavily modified GHG sources. These types of emissions, which contribute to climate change, are regulated under the Clean Air Act’s provisions to prevent new facilities from significantly decreasing air quality. While the EPA believes states are best positioned to regulate GHGs, the agency has been the GHG permitting authority in Arkansas since the state did not have such a program in place.

The State of Arkansas and EPA worked together to develop the state’s permitting program as a replacement for the federal plan. The EPA’s proposed approval will be published in the Federal Register in seven to 10 days and will available for public comment for 30 days.

Warwick, Lititz Receive EPA Award for Protecting Waters

(PHILADELPHIA – December 18, 2012) – The U.S. Environmental Protection Agency today honored two Lancaster County, Pa. communities for protecting sources of drinking water used by more than 20,000 people. EPA Regional Administrator Shawn M. Garvin presented the agency’s 2012 regional Source Water Protection Award to the Warwick Township Municipal Authority and the Borough of Lititz at a ceremony at the Warwick Municipal Office.
 “Protecting the sources of our drinking water benefits public health, our environment, and our economic well-being as well as our quality of life,” said Garvin. “Warwick and Lititz have shown the way for more than a decade of working with farmers and others in taking responsible steps protecting drinking water supplies.”
The Source Water Protection Award recognizes organizations and communities that take extraordinary steps to protect drinking water sources in EPA’s mid-Atlantic region.
Warwick and Lititz were recognized for their joint Wellhead Protection Program to protect groundwater sources from contamination. The communities were nominated for the award by the Pennsylvania Department of Environmental Protection.
“DEP is proud to nominate Warwick Township and Lititz Borough for their approach of working with local farmers,” DEP South-central Regional Director Lynn Langer said. “They have set the bar high for protecting drinking water, and hopefully other communities will follow their example.”
“We know that in order to protect our sensitive water supply we need to use many different approaches,” said Dan Zimmerman, Warwick Township Manager.
Sue Barry, Lititz Borough Manager explained, “We appreciate the willingness of our partners in the community and state, local and county governments who have helped to make this program successful.”
The communities created a steering committee of local stakeholders to guide their steps, supported state-of-the-art farming techniques and plans, sponsored public education activities, completed watershed improvement projects, and developed protective land use planning strategies and emergency water supply plans.

These steps are designed to deal with high levels of nutrient pollution in the heavily-agricultural area. More than 30 percent of the public water systems in Lancaster County have nitrate removal systems installed to assure that water provided to customers meets health-based standards.
The communities reported a steady decline in raw water nitrate concentrations for their drinking water sources, reducing treatment requirements and expenses.
The upgrade of the Lititz Sewer Authority’s wastewater treatment plant is helping to protect local waters and the Chesapeake Bay by significantly reducing nitrogen and phosphorus discharges to Lititz Run. The plant’s technology is also producing dried biosolids that are being used by local farmers as a slow release fertilizer as part of their nutrient management program.
Warwick and Lititz are the first Source Water Protection Award winners in Pennsylvania since 2009.
The federal Safe Drinking Water Act requires that states develop EPA-approved programs to assess all drinking waters sources in the state. These assessments define land areas contributing water to each public water supply system, identify potential sources of contamination, and determine how susceptible the water supply is to pollution. Utilities and citizens can then use the information to create protection programs.

PHILADELPHIA (Dec. 18, 2012) -- The U.S. Environmental Protection Agency has settled its complaint against Scully Welding Supply Corp. The company will pay a $60,791 penalty to settle alleged violations of the Clean Air Act at its retail gas facility at 309 Oak Lane in Collingdale, Pa.

 EPA cited the company for violating the Clean Air Act’s “General Duty Clause,” which requires regulated facilities to take steps to reduce the risk of accidental releases of hazardous substances and to minimize the consequences of any accidental releases that do occur. This provision is designed to protect the public from the threat of toxic chemical releases and accidents which may imperil workers, nearby residents and the environment.

EPA determined that Scully did not comply with this requirement in its storage and handling of three hazardous substances: chemolene (propylene), methanol, and propane. According to EPA, the company’s chemolene and methanol tanks were stored in a manner that created a fire hazard and were located too close to neighboring properties. Also, EPA alleged that the company did not have adequate safeguards to prevent fire hazards from electrical equipment near combustible materials, or to prevent accidental release of flammable liquids.

As part of the settlement, the company did not admit liability for the alleged violation, but has certified that it is now in compliance with the General Duty Clause of the Clean Air Act. The company replaced the aboveground propane storage tanks associated with the incident on September 1, 2010 with new underground tanks thereby minimizing the potential for vapor explosion and vessel rupture.  In addition, the company has removed its chemolene and methanol tanks.

Vitter secures extension of restoration efforts in area through 2017


(Washington, D.C.) – U.S. Senator David Vitter today announced that he has passed the Senate’s reauthorization of his Lake Pontchartrain Basin Restoration Act, which will continue restoration efforts in the Lake Pontchartrain Basin for five more years through 2017. In June Vitter got the legislation passed through the Environment and Public Works Committee. The legislation passed by unanimous consent in the Senate last night.
“Since passing the Lake Pontchartrain Basin Restoration Act in 2001 we’ve accomplished a lot – including improvements in water clarity and the return of pelicans, oysters, and blue crabs to the lake,” says Vitter. “But the work isn’t done, and my legislation allows us to continue to restore one of our nation’s estuary treasures and help the local communities address water infrastructure problems.”
“The Pontchartrain Restoration Program has been instrumental in improving the environmental health of the Pontchartrain Basin,” said Carlton Dufrechou, on behalf of the Pontchartrain Restoration Program Executive Committee. “It’s been the catalyst for over 100 projects that have reduced pollution from sewerage plants, dairy operations, and helped preserve Louisiana’s fragile coast.  And the results are quantifiable.  Lake Pontchartrain is again fishable and swimmable.”
The Lake Pontchartrain Basin Restoration Act was the first bill that Vitter helped pass into law as a freshman Congressman in 2001.  The Act created a partnership between the federal government and local stakeholders to restore and support the lake and its surrounding areas. It also granted Lake Pontchartrain restoration efforts with similar status as the Great Lakes and Florida Everglades restoration efforts. Through this program, Vitter has enabled nearly a decade of cleanup efforts and restoration in the Lake Pontchartrain Basin. He also got it reauthorized in 2006.
Lake Pontchartrain is one of the largest estuaries in the United States and is surrounded by over 1.5 million residents, making it the most populated area in the state of Louisiana. The 16 parishes in the Lake Pontchartrain Basin are Ascension, East Baton Rouge, East Feliciana, Iberville, Jefferson, Livingston, Orleans, Plaquemines, St. Bernard, St. Charles, St. Helena, St. James, St. John the Baptist, St. Tammany, Tangipahoa and Washington.
The legislation still awaits passage by the U.S. House of Representatives before it can become law.

At the urging of Sen. David Vitter, the Senate Environment and Public Works Committee passed a measure reauthorizing the act for five more years, through 2017. The full Senate should support the bill to continue efforts to restore one of the region's most important environmental assets.
The lake was in sorry shape when environmentalists began efforts to clean it up more than three decades ago. Poorly treated wastewater from Jefferson Parish had flowed into the lake for years, and the once pristine lake had been turned into a slushy soup by decades of dredging for clam shells to be used in roadbeds and other foundations.
In the mid-1980s, however, Jefferson Parish agreed to replace its outdated sewage plant and pump treated water to the Mississippi River instead. A few years later, at the urging of the Lake Pontchartrain Basin Foundation and other advocates, the state shut down dredging, saying it violated federal water quality standards.
But to make even further progress, advocates needed the financial muscle of the federal government. That finally came in 2000, when then U.S. Rep. Vitter introduced the lake restoration act and pushed hard for its passage in the House, while Sen. Mary Landrieu sponsored the bill in the Senate.
The act created a partnership between the federal government and local entities to restore the lake and other bodies of water that flow into it. The 640-square-mile Lake Pontchartrain is one of the nation's largest estuaries, and the act granted efforts to save it a status comparable to restoration campaigns in the Great Lakes and the Florida Everglades. More importantly, the act spurred Congress to appropriate millions of dollars for projects to restore the lake and to minimize the negative impact of human activity around it. In particular, federal grants made possible by the act have financed expensive sewer and water improvements in parishes across the basin, helping improve water quality in the lake.
That's why Congress should support the reauthorization of the act -- and also approve the necessary funding to continue restoration efforts.
